Amends the Election Code. Provides that a person who (i) filed a statement of candidacy as an established political party's candidate at a general primary or (ii) voted at an established political party's general primary may not file a statement of candidacy as an independent candidate or as a different party's candidate at the immediately following general election. A person may file a statement of candidacy for a partisan office as a qualified primary voter of an established political party regardless of any prior filing of candidacy for a partisan office or voting the ballot of an established political party at any prior election. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Election Code is amended by adding Section |
5 | | 7-10.4 as follows: |
6 | | (10 ILCS 5/7-10.4 new) |
7 | | Sec. 7-10.4. Statement of candidacy; different political |
8 | | party. A person (i) who filed a statement of candidacy for a |
9 | | partisan office as a qualified primary voter of an established |
10 | | political party or (ii) who voted the ballot of an established |
11 | | political party at a general primary election may not file a |
12 | | statement of candidacy as a candidate of a different |
13 | | established political party or as an independent candidate for |
14 | | a partisan office to be filled at the general election |
15 | | immediately following the general primary for which the person |
16 | | filed the statement or voted the ballot. Except as otherwise |
17 | | provided in this Section, a person may file a statement of |
18 | | candidacy for a partisan office as a qualified primary voter of |
19 | | an established political party regardless of any prior filing |
20 | | of candidacy for a partisan office or voting the ballot of an |
21 | | established political party at any prior election.
