1 | | AN ACT concerning safety.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Firearm Owners Identification Card Act is |
5 | | amended by changing Section 13.1 as follows:
|
6 | | (430 ILCS 65/13.1) (from Ch. 38, par. 83-13.1)
|
7 | | Sec. 13.1.
It is unlawful for any unit of local government, |
8 | | including a home rule unit of government, to require any person |
9 | | to obtain any permit or license, other than a Firearm Owner's |
10 | | Identification Card, in order to own or possess a firearm for |
11 | | his or her personal use. It is declared to be the policy of |
12 | | this State that the regulation of the right to own or possess a |
13 | | firearm is an exclusive power and function of the State. A home |
14 | | rule unit may not regulate the ownership or possession of |
15 | | firearms. This Section is a denial and limitation of home rule |
16 | | powers and functions under subsection (h) of Section 6 of |
17 | | Article VII of the Illinois Constitution. The provisions of any |
18 | | ordinance enacted by any municipality which
requires |
19 | | registration or imposes greater restrictions or limitations on |
20 | | the
acquisition, possession and transfer of firearms than are |
21 | | imposed by this
Act, are not invalidated or affected by this |
22 | | Act.
