Amends the Transparency in College Textbook Publishing Practices Act. Prohibits a publisher of college textbooks from offering or giving anything of monetary value to any person involved in the selection of a textbook or supplemental material for a course taught at a public institution of higher education if the offer or gift influences or is intended to influence the action or judgment of the person in selecting a textbook or supplemental material. Prohibits a person involved in the selection of a textbook or supplemental material for a course taught at an institution from soliciting or accepting anything of monetary value from a publisher of college textbooks if the solicitation or acceptance influences or is intended to influence the action or judgment of the person in selecting a textbook or supplemental material. Sets forth exceptions to these prohibitions. Provides that a person who violates the prohibitions is guilty of a petty offense. Effective July 1, 2013.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Transparency in College Textbook Publishing |
5 | | Practices Act is amended by adding Section 23 as follows: |
6 | | (110 ILCS 78/23 new) |
7 | | Sec. 23. Prohibited practices. |
8 | | (a) No publisher of college textbooks may offer or give |
9 | | anything of monetary value to any person involved in the |
10 | | selection of a textbook or supplemental material for a course |
11 | | taught at an institution if the offer or gift influences or is |
12 | | intended to influence the action or judgment of the person in |
13 | | selecting a textbook or supplemental material. |
14 | | (b) No person involved in the selection of a textbook or |
15 | | supplemental material for a course taught at an institution may |
16 | | solicit or accept anything of monetary value from a publisher |
17 | | of college textbooks if the solicitation or acceptance |
18 | | influences or is intended to influence the action or judgment |
19 | | of the person in selecting a textbook or supplemental material. |
20 | | (c) This Section does not apply to any compensation or |
21 | | royalties paid by a publisher to the author or editor of or |
22 | | contributor to a textbook or supplemental material. This |
23 | | Section does not apply to a textbook or supplemental material |
