Amends the Illinois Controlled Substances Act. Makes a technical change in

2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Controlled Substances Act is |
5 | | amended by changing Section 407.2 as follows:
|
6 | | (720 ILCS 570/407.2) (from Ch. 56 1/2, par. 1407.2)
|
7 | | Sec. 407.2. Delivery of a controlled substance to a |
8 | | pregnant woman.
|
9 | | (a) Any person who violates subsection (a) of Section 401 |
10 | | of this Act by
delivering a controlled substance to a woman he |
11 | | knows to be pregnant may be
sentenced to imprisonment for a |
12 | | term twice the
the maximum amount authorized by
Section 401 of |
13 | | this Act. |
14 | | (b) Any person who delivers an amount of a controlled |
15 | | substance set
forth in subsections (c) and (d) of Section 401 |
16 | | of this Act to a woman he
knows to be pregnant commits a Class 1 |
17 | | felony. The fine for a violation of
this subsection (b) shall |
18 | | not be more than $250,000.
