AMENDMENT TO HOUSE BILL 4858

2    AMENDMENT NO. ______. Amend House Bill 4858 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 11-1303 as follows:
 
6    (625 ILCS 5/11-1303)  (from Ch. 95 1/2, par. 11-1303)
7    Sec. 11-1303. Stopping, standing or parking prohibited in
8specified places.
9    (a) Except when necessary to avoid conflict with other
10traffic, or in compliance with law or the directions of a
11police officer or official traffic-control device, no person
12shall:
13        1. Stop, stand or park a vehicle:
14            a. On the roadway side of any vehicle stopped or
15        parked at the edge or curb of a street;
16            b. On a sidewalk;

1            c. Within an intersection;
2            d. On a crosswalk;
3            e. Between a safety zone and the adjacent curb or
4        within 30 feet of points on the curb immediately
5        opposite the ends of a safety zone, unless a different
6        length is indicated by signs or markings;
7            f. Alongside or opposite any street excavation or
8        obstruction when stopping, standing or parking would
9        obstruct traffic;
10            g. Upon any bridge or other elevated structure upon
11        a highway or within a highway tunnel;
12            h. (Blank); On any railroad tracks. A violation of
13        any part of this subparagraph h. shall result in a
14        mandatory fine of $500 or 50 hours of community
15        service.
16            i. At any place where official signs prohibit
17        stopping;
18            j. On any controlled-access highway;
19            k. In the area between roadways of a divided
20        highway, including crossovers;
21            l. In a public parking area if the vehicle does not
22        display a current annual registration sticker or
23        current temporary permit pending registration.
24        2. Stand or park a vehicle, whether occupied or not,
25    except momentarily to pick up or discharge passengers:
26            a. In front of a public or private driveway;

1            b. Within 15 feet of a fire hydrant;
2            c. Within 20 feet of a crosswalk at an
3        intersection;
4            d. Within 30 feet upon the approach to any flashing
5        signal, stop sign, yield sign, or traffic control
6        signal located at the side of a roadway;
7            e. Within 20 feet of the driveway entrance to any
8        fire station and on the side of a street opposite the
9        entrance to any fire station within 75 feet of such
10        entrance (when properly sign-posted);
11            f. At any place where official signs prohibit
12        standing.
13        3. Park a vehicle, whether occupied or not, except
14    temporarily for the purpose of and while actually engaged
15    in loading or unloading property or passengers:
16            a. Within 50 feet of the nearest rail of a railroad
17        crossing;
18            b. At any place where official signs prohibit
19        parking.
20    (b) No person shall move a vehicle not lawfully under his
21control into any such prohibited area or away from a curb such
22distance as is unlawful.
23    (c) A person may not knowingly leave a motor vehicle on any
24portion of a railroad track. A violation of this subsection (c)
25is a Class 4 felony, except if a person commits a violation of
26this subsection (c) and the violation is a proximate cause of

1death or great bodily harm to another person, the violation is
2a Class 2 felony.
3    This subsection (c) does not apply if a motor vehicle is
4left on a railroad track because of a mechanical failure,
5provided that the person in control of the vehicle at the time
6of the mechanical failure immediately makes a reasonable effort
7to have the vehicle removed from the track or to notify law
8enforcement of the location of the vehicle.
