AMENDMENT TO HOUSE BILL 4838




2    AMENDMENT NO. ______. Amend House Bill 4838 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Illinois Public Aid Code is amended  by 
5adding Section 12-4.45 as follows:
 
6    (305 ILCS 5/12-4.45 new)
7    Sec. 12-4.45. Intergovernmental agreements; death records. 
8The Department shall enter into intergovernmental agreements 
9to conduct monthly exchanges of information with the Department 
10of Public Health and  the offices of the county clerk to 
11determine whether any individual included in an assistance unit 
12receiving public aid under any Article of this Code is 
13deceased. The Department shall review each month the entire 
14list of individuals generated by the monthly exchange and shall 
15verify the eligibility for benefits under this Code for each 
16individual on the list. The Department shall terminate benefits

1under this Code for any deceased individual determined by this 
2monthly review. The Department shall use any legal means 
3available to recoup as an overpayment any assistance provided 
4to an individual for any period during which he or she was 
5ineligible to receive assistance.".
