1 | AN ACT concerning local government.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Street Light District Act is amended by | |||||||||||||||||||
5 | changing Section 3 as follows:
| |||||||||||||||||||

| |||||||||||||||||||
7 | Sec. 3.
A board of of trustees consisting of 3 members for | |||||||||||||||||||
8 | the
government and control of the affairs and business of the | |||||||||||||||||||
9 | street lighting
district incorporated under this Act shall be | |||||||||||||||||||
10 | created in the following manner:
| |||||||||||||||||||
11 | (1) If the district is located wholly within a single | |||||||||||||||||||
12 | county,
trustees for the district shall
be appointed by the | |||||||||||||||||||
13 | presiding officer of the county board with the advice
and | |||||||||||||||||||
14 | consent of the county board;
| |||||||||||||||||||
15 | (2) If the district is located in more than one county, the
| |||||||||||||||||||
16 | number of trustees who are residents of a county shall be in | |||||||||||||||||||
17 | proportion,
as nearly as practicable, to the number of | |||||||||||||||||||
18 | residents of the district who
reside in that county in relation | |||||||||||||||||||
19 | to the total population of the district.

20 | Upon the expiration of the term of a trustee who is in | |||||||||||||||||||
21 | office
on the effective date of this amendatory Act of 1975, | |||||||||||||||||||
22 | the successor shall
be a resident of whichever county is | |||||||||||||||||||
23 | entitled to such representation in
order to bring about the |
| |||||||
| |||||||
1 | proportional representation required herein,
and he shall be | ||||||
2 | appointed by the county board of that county, or
in the case of | ||||||
3 | a home rule county as defined by Article VII,
Section 6 of the | ||||||
4 | Constitution of 1970, the chief executive officer
of that | ||||||
5 | county, with the advice and consent of the county board.
| ||||||
6 | Thereafter, each trustee shall be succeeded by a
resident | ||||||
7 | of the same county who shall be appointed by the
same | ||||||
8 | appointing authority; however, the provisions of the
preceding | ||||||
9 | paragraph shall apply to the appointment of the
successor to | ||||||
10 | each trustee who is in office at the time of
the publication of | ||||||
11 | each decennial Federal census of population.

12 | Within 60 days after the creation of a street lighting | ||||||
13 | district as
provided in Section 1 hereof, the appropriate | ||||||
14 | appointing authority shall
appoint 3 trustees. The trustees | ||||||
15 | shall hold their offices for one, 2 and 3
years from the first | ||||||
16 | Monday of May next after their appointment and until
their | ||||||
17 | successors have been appointed and qualified. Thereafter on or | ||||||
18 | before
the second Monday in April of each year the appointing | ||||||
19 | authority shall
appoint one trustee whose term shall be for 3 | ||||||
20 | years commencing on the first
Monday in May next after they are | ||||||
21 | respectively appointed. The length of
term of the first | ||||||
22 | trustees shall be determined by lot at their first
meeting.

23 | The appointing authority shall require each of the trustees | ||||||
24 | to enter
into bond with security to be approved by the | ||||||
25 | appointing authority in such
sum as the appointing authority | ||||||
26 | may determine.

| |||||||
1 | A majority of the board of trustees shall constitute a | ||||||
2 | quorum. No
trustee or employee of the district shall be | ||||||
3 | directly or indirectly
interested financially in any contract, | ||||||
4 | work or business or the sale of any
article, the expense, price | ||||||
5 | or consideration of which is paid by the
district. The trustees | ||||||
6 | shall provide and adopt a corporate seal for the
district.
