AMENDMENT TO HOUSE BILL 4692

2    AMENDMENT NO. ______. Amend House Bill 4692 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by adding
5Section 5.811 as follows:
 
6    (30 ILCS 105/5.811 new)
7    Sec. 5.811. The Illinois Nurses Foundation Fund.
 
8    Section 10. The Illinois Vehicle Code is amended by
9changing Section 6-110 and by adding Section 3-699 as follows:
 
10    (625 ILCS 5/3-699 new)
11    Sec. 3-699. Illinois Nurses license plates.
12    (a) The Secretary, upon receipt of an application made in
13the form prescribed by the Secretary, may issue special
14registration plates designated as Illinois Nurses license

1plates. The special plates issued under this Section shall be
2affixed only to passenger vehicles of the first division and
3motor vehicles of the second division weighing not more than
48,000 pounds. Plates issued under this Section shall expire
5according to the multi-year procedure established by Section
63-414.1 of this Code.
7    (b) The design and color of the plates is wholly within the
8discretion of the Secretary. The Secretary may allow the plates
9to be issued as vanity plates or personalized under Section
103-405.1 of the Code. The Secretary shall prescribe stickers or
11decals as provided under Section 3-412 of this Code.
12    (c) An applicant for the special plate shall be charged a
13$35 fee for original issuance in addition to the appropriate
14registration fee. Of this fee, $20 shall be deposited into the
15Illinois Nurses Foundation Fund and $15 shall be deposited into
16the Secretary of State Special License Plate Fund, to be used
17by the Secretary to help defray administrative processing
18costs.
19    For each registration renewal period, a $22 fee, in
20addition to the appropriate registration fee, shall be charged.
21Of this fee, $20 shall be deposited into the Illinois Nurses
22Foundation Fund and $2 shall be deposited into the Secretary of
23State Special License Plate Fund.
24    (d) The Illinois Nurses Foundation Fund is created as a
25special fund in the State treasury. All money in the Illinois
26Nurses Foundation Fund shall be paid, subject to appropriation

1by the General Assembly and distribution by the Secretary, as
2grants to the Illinois Nurses Foundation, to promote the health
3of the public by advancing the nursing profession in this
4State. Any scholarships awarded under this Section shall be
5distributed to students pursuing an associate, baccalaureate,
6or graduate degree in nursing.

8    Sec. 6-110. Licenses issued to drivers.
9    (a) The Secretary of State shall issue to every qualifying
10applicant a driver's license as applied for, which license
11shall bear a distinguishing number assigned to the licensee,
12the legal name, signature, zip code, date of birth, residence
13address, and a brief description of the licensee.
14    Licenses issued shall also indicate the classification and
15the restrictions under Section 6-104 of this Code. The
16Secretary may adopt rules to establish informational
17restrictions that can be placed on the driver's license
18regarding specific conditions of the licensee.
19    A driver's license issued may, in the discretion of the
20Secretary, include a suitable photograph of a type prescribed
21by the Secretary.
22    (a-1) If the licensee is less than 18 years of age, unless
23one of the exceptions in subsection (a-2) apply, the license
24shall, as a matter of law, be invalid for the operation of any
25motor vehicle during the following times:

1        (A) Between 11:00 p.m. Friday and 6:00 a.m. Saturday;
2        (B) Between 11:00 p.m. Saturday and 6:00 a.m. on
3    Sunday; and
4        (C) Between 10:00 p.m. on Sunday to Thursday,
5    inclusive, and 6:00 a.m. on the following day.
6    (a-2) The driver's license of a person under the age of 18
7shall not be invalid as described in subsection (a-1) of this
8Section if the licensee under the age of 18 was:
9        (1) accompanied by the licensee's parent or guardian or
10    other person in custody or control of the minor;
11        (2) on an errand at the direction of the minor's parent
12    or guardian, without any detour or stop;
13        (3) in a motor vehicle involved in interstate travel;
14        (4) going to or returning home from an employment
15    activity, without any detour or stop;
16        (5) involved in an emergency;
17        (6) going to or returning home from, without any detour
18    or stop, an official school, religious, or other
19    recreational activity supervised by adults and sponsored
20    by a government or governmental agency, a civic
21    organization, or another similar entity that takes
22    responsibility for the licensee, without any detour or
23    stop;
24        (7) exercising First Amendment rights protected by the
25    United States Constitution, such as the free exercise of
26    religion, freedom of speech, and the right of assembly; or

1        (8) married or had been married or is an emancipated
2    minor under the Emancipation of Minors Act.
3    (a-2.5) The driver's license of a person who is 17 years of
4age and has been licensed for at least 12 months is not invalid
5as described in subsection (a-1) of this Section while the
6licensee is participating as an assigned driver in a Safe Rides
7program that meets the following criteria:
8        (1) the program is sponsored by the Boy Scouts of
9    America or another national public service organization;
10    and
11        (2) the sponsoring organization carries liability
12    insurance covering the program.
13    (a-3) If a graduated driver's license holder over the age
14of 18 committed an offense against traffic regulations
15governing the movement of vehicles or any violation of Section
166-107 or Section 12-603.1 of this Code in the 6 months prior to
17the graduated driver's license holder's 18th birthday, and was
18subsequently convicted of the offense, the provisions of
19subsection (a-1) shall continue to apply until such time as a
20period of 6 consecutive months has elapsed without an
21additional violation and subsequent conviction of an offense
22against traffic regulations governing the movement of vehicles
23or Section 6-107 or Section 12-603.1 of this Code.
24    (a-4) If an applicant for a driver's license or instruction
25permit has a current identification card issued by the
26Secretary of State, the Secretary may require the applicant to

1utilize the same residence address and name on the
2identification card, driver's license, and instruction permit
3records maintained by the Secretary. The Secretary may
4promulgate rules to implement this provision.
5    (b) Until the Secretary of State establishes a First Person
6Consent organ and tissue donor registry under Section 6-117 of
7this Code, the Secretary of State shall provide a format on the
8reverse of each driver's license issued which the licensee may
9use to execute a document of gift conforming to the provisions
10of the Illinois Anatomical Gift Act. The format shall allow the
11licensee to indicate the gift intended, whether specific
12organs, any organ, or the entire body, and shall accommodate
13the signatures of the donor and 2 witnesses. The Secretary
14shall also inform each applicant or licensee of this format,
15describe the procedure for its execution, and may offer the
16necessary witnesses; provided that in so doing, the Secretary
17shall advise the applicant or licensee that he or she is under
18no compulsion to execute a document of gift. A brochure
19explaining this method of executing an anatomical gift document
20shall be given to each applicant or licensee. The brochure
21shall advise the applicant or licensee that he or she is under
22no compulsion to execute a document of gift, and that he or she
23may wish to consult with family, friends or clergy before doing
24so. The Secretary of State may undertake additional efforts,
25including education and awareness activities, to promote organ
26and tissue donation.

1    (c) The Secretary of State shall designate on each driver's
2license issued a space where the licensee may place a sticker
3or decal of the uniform size as the Secretary may specify,
4which sticker or decal may indicate in appropriate language
5that the owner of the license carries an Emergency Medical
6Information Card.
7    The sticker may be provided by any person, hospital,
8school, medical group, or association interested in assisting
9in implementing the Emergency Medical Information Card, but
10shall meet the specifications as the Secretary may by rule or
11regulation require.
12    (d) The Secretary of State shall designate on each driver's
13license issued a space where the licensee may indicate his
14blood type and RH factor.
15    (e) The Secretary of State shall provide that each original
16or renewal driver's license issued to a licensee under 21 years
17of age shall be of a distinct nature from those driver's
18licenses issued to individuals 21 years of age and older. The
19color designated for driver's licenses for licensees under 21
20years of age shall be at the discretion of the Secretary of
21State.
22    (e-1) The Secretary shall provide that each driver's
23license issued to a person under the age of 21 displays the
24date upon which the person becomes 18 years of age and the date
25upon which the person becomes 21 years of age.
26    (f) The Secretary of State shall inform all Illinois

1licensed commercial motor vehicle operators of the
2requirements of the Uniform Commercial Driver License Act,
3Article V of this Chapter, and shall make provisions to insure
4that all drivers, seeking to obtain a commercial driver's
5license, be afforded an opportunity prior to April 1, 1992, to
6obtain the license. The Secretary is authorized to extend
7driver's license expiration dates, and assign specific times,
8dates and locations where these commercial driver's tests shall
9be conducted. Any applicant, regardless of the current
10expiration date of the applicant's driver's license, may be
11subject to any assignment by the Secretary. Failure to comply
12with the Secretary's assignment may result in the applicant's
13forfeiture of an opportunity to receive a commercial driver's
14license prior to April 1, 1992.
15    (g) The Secretary of State shall designate on a driver's
16license issued, a space where the licensee may indicate that he
17or she has drafted a living will in accordance with the
18Illinois Living Will Act or a durable power of attorney for
19health care in accordance with the Illinois Power of Attorney
20Act.
21    (g-1) The Secretary of State, in his or her discretion, may
22designate on each driver's license issued a space where the
23licensee may place a sticker or decal, issued by the Secretary
24of State, of uniform size as the Secretary may specify, that
25shall indicate in appropriate language that the owner of the
26license has renewed his or her driver's license.

1    (h) A person who acts in good faith in accordance with the
2terms of this Section is not liable for damages in any civil
3action or subject to prosecution in any criminal proceeding for
4his or her act.
