| 8 | | Program shall submit to a criminal history background check. |
| 9 | | The Department shall promulgate rules that (i) are necessary to |
| 10 | | implement this provision; and (ii) indicate any condition or |
| 11 | | circumstance when a personal assistant or individual provider |
| 12 | | shall be denied employment as a result of the criminal history |
| 13 | | background check. For purposes of this paragraph, "individual |
| 14 | | provider" means a person providing services under the Home |
| 15 | | Services Program who is a personal assistant, registered nurse, |
| 16 | | licensed practical nurse, certified nurse assistant, |
| 17 | | occupational therapist, physical therapist, or speech |
