| 5 | | on page 6, by replacing lines 4 through 17 with the following: |
| 6 | | "Any person providing services as a personal assistant or |
| 7 | | an individual provider under the Department's Home Services |
| 8 | | Program shall submit to a criminal history background check. |
| 9 | | The Department shall promulgate rules that (i) are necessary to |
| 10 | | implement this provision; and (ii) indicate any condition or |
| 11 | | circumstance when a personal assistant or individual provider |
| 12 | | shall be denied employment as a result of the criminal history |
| 13 | | background check. For purposes of this paragraph "individual |
| 14 | | provider" means a person other than a personal assistant who |
| 15 | | provides care, including, but not limited to, a nurse, a |
| 16 | | certified nursing assistant (CNA), or a physical therapist.".
