SYNOPSIS AS INTRODUCED:
 
225 ILCS 320/35  from Ch. 111, par. 1133

    Amends the Illinois Plumbing License Law. Provides that by January 1, 2013, the Illinois Department of Public Health shall amend the existing minimum code of standards for plumbing and the fixtures, materials, design, and installation methods of plumbing systems to reflect advances in those technologies and methods that more efficiently utilize natural resources and protect public health. Provides that the Department shall consider the recommendations contained in nationally and internationally recognized plumbing codes and recommendations of nationally and internationally recognized material and equipment testing laboratories so that the State's plumbing code standards are consistent with the leading technologies and methods that more efficiently utilize natural resources and protect public health. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Plumbing License Law is amended by
5changing Section 35 as follows:
 
6    (225 ILCS 320/35)  (from Ch. 111, par. 1133)
7    Sec. 35. The Department shall promulgate and publish and
8may from time to time amend a minimum code of standards for
9plumbing and the fixtures, materials, design and installation
10methods of plumbing systems based upon the findings of the
11sciences of pneumatics and hydraulics, after consideration of
12the recommendations of the Plumbing Code Advisory Council. By
13January 1, 2013, the Department shall amend the existing
14minimum code of standards for plumbing and the fixtures,
15materials, design, and installation methods of plumbing
16systems to reflect advances in those technologies and methods
17that more efficiently utilize natural resources and protect
18public health. The Department may promulgate and publish rules
19in the State's minimum code of standards for the minimum number
20of plumbing fixtures required for the comfort and convenience
21of workers and the public not inconsistent with, but not
22limited to, the requirements of the federal Americans With
23Disabilities Act, the Equitable Restrooms Act, and the U.S.

1Department of Labor, Office of Safety and Health
2Administration. The minimum code of standards for plumbing and
3any amendments thereto shall be filed with the Secretary of
4State as a public record. In preparing plumbing code standards
5and amendments thereto the Department shall consider may give
6consideration to the recommendations contained in nationally
7and internationally recognized plumbing codes and
8recommendations of nationally and internationally recognized
9material and equipment testing laboratories so that the State's
10plumbing code standards are consistent with the leading
11technologies and methods that more efficiently utilize natural
12resources and protect public health. The plumbing code
13promulgated by the Department under authority of this Act shall
14remain in effect as the minimum code authorized by this Act
15until the Department promulgates a new code under authority of
16this Act. At least 20 days' notice of a public hearing shall be
17given by the Department in a manner which the Department
18considers adequate to bring the hearing to the attention of
19persons interested in plumbing code standards. Notice of any
20public hearing shall be given by the Department to those who
21file a request for a notice of hearings.

23    Section 99. Effective date. This Act takes effect upon
24becoming law.
