Amends the Safe Pharmaceutical Disposal Act. Provides that a health care institution may re-prescribe unused medications for use by a new patient receiving health care from the institution. Provides that nothing in the amendatory provisions authorizes the re-prescription of any expired medication. Authorizes State regulatory oversight agencies to adopt rules to provide for the safe implementation of the amendatory Act. Effective immediately.

1 | | AN ACT concerning regulation.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Safe Pharmaceutical Disposal Act is amended |
5 | | by adding Section 12 as follows: |
6 | | (210 ILCS 150/12 new) |
7 | | Sec. 12. Re-prescription of unused medications. |
8 | | (a) A health care institution may re-prescribe unused |
9 | | medications for use by a new patient receiving health care from |
10 | | the institution. |
11 | | (b) Nothing in this Section authorizes the re-prescription |
12 | | of any expired medication. |
13 | | (c) Any agency having regulatory oversight responsibility |
14 | | as described in Section 20 may adopt rules to provide for the |
15 | | safe implementation of this amendatory Act of the 97th General |
16 | | Assembly.

17 | | Section 99. Effective date. This Act takes effect upon |
18 | | becoming law.
