SYNOPSIS AS INTRODUCED:
 
410 ILCS 325/9  from Ch. 111 1/2, par. 7409

    Amends the Illinois Sexually Transmissible Disease Control Act. Provides that the Department of Public Health, in consultation with the Department of Corrections and local health departments, shall develop and implement written procedures that establish a process for confidentially notifying and recommending sexually transmissible disease testing of (1) contacts in the community of a prisoner diagnosed with a sexually transmissible disease and (2) prisoners whose contacts in the community or in the prison have been diagnosed with a sexually transmissible disease. Sets forth requirements concerning the process. Effective immediately.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Sexually Transmissible Disease
5Control Act is amended by changing Section 9 as follows:
 
6    (410 ILCS 325/9)  (from Ch. 111 1/2, par. 7409)
7    Sec. 9. Prisoners.
8    (a) The Department and its authorized representatives may,
9at its discretion, enter any State, county or municipal
10detention facility to interview, examine and treat any prisoner
11for a sexually transmissible disease. Any such State, county or
12municipal detention facility shall cooperate with the
13Department and its authorized representative to provide such
14space as is necessary for the examination and treatment of all
15prisoners suffering from or suspected of having a sexually
16transmissible disease.
17    (b) Nothing in this Section shall be construed as relieving
18the Department of Corrections or any county or municipality of
19their primary responsibility for providing medical treatment
20for prisoners under their jurisdiction, including treatment
21for sexually transmissible diseases.
22    (c) Any person who knowingly or maliciously disseminates
23any false information or report concerning the existence of any

1sexually transmissible disease under this Section is guilty of
2a Class A misdemeanor.
3    (d) The Department, in consultation with the Department of
4Corrections and local health departments, shall develop and
5implement written procedures that establish a process for
6confidentially notifying and recommending sexually
7transmissible disease testing of (1) contacts in the community
8of a prisoner diagnosed with a sexually transmissible disease
9and (2) prisoners whose contacts in the community or in the
10prison have been diagnosed with a sexually transmissible
11disease. The process shall include a single point of contact in
12each Department for the notification. The process shall be in
13accordance with Sections 3, 5, and 8 of this Act.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.
