AMENDMENT TO HOUSE BILL 4238




2    AMENDMENT NO. ______. Amend House Bill 4238 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 5. The Property Tax Code is amended  by adding 
5Section 27-88 as follows:
 
6    (35 ILCS 200/27-88 new)
7    Sec. 27-88. Special service area for energy conservation.  A 
8municipality may propose a special service area, as provided in 
9this Law, for the purpose of providing energy conservation 
10measures to any residential or commercial building, provided 
11that 100% of the owners of the real property within the 
12proposed special service area file a petition with the clerk of 
13the municipality agreeing with the establishment of the special 
14service area.  If a petition is not filed or contains an 
15insufficient number of signatures, the corporate authorities 
16of the municipality may not proceed further, and the

1establishment of the same special service area shall not again 
2be initiated for a period of one year.  The term "energy 
3conservation measures" has the meaning ascribed to that term in 
4Section 5 of the Local Government Energy Conservation Act.
  
 
5    Section 99. Effective date. This Act takes effect upon 
6becoming law.".
