2 | | AMENDMENT NO. ______. Amend House Bill 4191 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The State Officials and Employees Ethics Act is |
5 | | amended by changing Section 20-52 as follows: |
6 | | (5 ILCS 430/20-52) |
7 | | Sec. 20-52. Release of summary reports. |
8 | | (a) Within 60 days after receipt of a summary report and |
9 | | response from the ultimate jurisdictional authority or agency |
10 | | head , if the conduct at issue in the report that resulted in a |
11 | | suspension of at least 3 days or termination of employment , or |
12 | | if an Executive Inspector General determines, and the |
13 | | Commission agrees, that the conduct at issue in the report |
14 | | resulted in the loss of public funds in an amount of $5,000 or |
15 | | greater , the Executive Ethics Commission shall make available |
16 | | to the public the report and response or a redacted version of |

1 | | the report and response. The Executive Ethics Commission may |
2 | | make available to the public any other summary report and |
3 | | response of the ultimate jurisdictional authority or agency |
4 | | head or a redacted version of the report and response. |
5 | | (b) The Commission shall redact information in the summary |
6 | | report that may reveal the identity of witnesses, complainants, |
7 | | or informants or if the Commission determines that the identity |
8 | | of any person named in the report is unnecessary, or that it is |
9 | | appropriate to protect the identity of a person before the |
10 | | report is made public. The Commission may also redact any |
11 | | information it believes should not be made public. Prior to |
12 | | publication, the Commission shall permit the respondents, the |
13 | | Executive Inspector General, and Attorney General to review |
14 | | documents to be made public and offer suggestions for redaction |
15 | | or provide a response that shall be made public with the |
16 | | summary report. |
17 | | (c) The Commission may withhold publication of the report |
18 | | or response if the Executive Inspector General or Attorney |
19 | | General certifies that releasing the report to the public will |
20 | | interfere with an ongoing investigation.
