Creates the Department of Education Act and amends the Civil Administrative Code of Illinois, the School Code, the Board of Higher Education Act, and the Public Community College Act. Creates the Department of Education, with a Secretary of Education as its head. Provides that, in order to create continuity between all levels of education, the Department shall oversee the State Board of Education, the Board of Higher Education, and the Illinois Community College Board and coordinate and streamline the functions of these boards until January 1, 2014. Provides that all of the rights, powers, duties, and functions vested by law in the State Board of Education (except the State Board of Education's duty under the Illinois Constitution to appoint a chief State educational officer), the State Superintendent of Education, the Board of Higher Education, and the Illinois Community College Board are transferred to the Department of Education on January 1,
2014; abolishes the Board of Higher Education and the Illinois Community College Board on that date. Provides for the transfer of personnel and property. Makes other changes.

|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 1. Short title. This Act may be cited as the |
5 | | Department of Education Act. |
6 | | Section 5. Department defined. In this Act, "Department" |
7 | | means the Department of Education. |
8 | | Section 10. General powers and duties. |
9 | | (a) The Department shall begin operation on July 1, 2013. |
10 | | The Department shall exercise the rights, powers, duties, and |
11 | | functions provided by law, including without limitation the |
12 | | rights,
powers, duties, and functions transferred to the |
13 | | Department under
Section 15 of this Act. |
14 | | (b) The Department may employee persons, provide |
15 | | facilities, contract for goods and services, and adopt rules as |
16 | | necessary to carry out its functions and purposes, all in |
17 | | accordance with applicable law.

18 | | (c) In order to create continuity between all levels of |
19 | | education, the Department shall oversee the State Board of |
20 | | Education, the Board of Higher Education, and the Illinois |
21 | | Community College Board and coordinate and streamline the |
22 | | functions of these boards until January 1, 2014.

1 | | (d) The Department shall create an Elementary and Secondary |
2 | | Education Division and a Vocational Education Division within |
3 | | the Department.

4 | | Section 15. Transfer of powers. Except as otherwise |
5 | | provided in
subsection (b) of Section 2 of Article X of the |
6 | | Constitution of the State of
Illinois and subsection B of |
7 | | Section 1A-4 of the School Code, all of the rights, powers, |
8 | | duties, and functions vested by
law in the State Board of |
9 | | Education, the State Superintendent of
Education, the Board of |
10 | | Higher Education, or the Illinois Community College Board or in |
11 | | any office, council, committee, division, or bureau of
the |
12 | | State Board of Education, the State Superintendent of |
13 | | Education, the Board of Higher Education, or the Illinois |
14 | | Community College Board
are transferred to the Department on |
15 | | January 1, 2014. |
16 | | Section 20. Transfer of personnel. |
17 | | (a) Personnel employed by the State Board of Education, the
|
18 | | State Superintendent of Education, the Board of Higher |
19 | | Education, or the Illinois Community College Board on December |
20 | | 31, 2013 are
transferred to the Department on January 1, 2014.
|
21 | | (b) The Department shall continue in effect all collective |
22 | | bargaining agreements in existence on December 31, 2013 between |
23 | | the State Board of Education, the Board of Higher Education, or |
24 | | the Illinois Community College Board and labor organizations |

1 | | representing personnel of the State Board of Education, the |
2 | | Board of Higher Education, or the Illinois Community College |
3 | | Board, respectively, and the Department shall continue to |
4 | | recognize these labor organizations as the exclusive |
5 | | bargaining representatives for the personnel, pursuant to the |
6 | | Illinois Educational Labor Relations Act. |
7 | | (c) The rights of State employees, the State, and its |
8 | | agencies
under the Personnel Code and applicable collective |
9 | | bargaining
agreements and retirement plans are not affected by |
10 | | this Act.
|
11 | | Section 25. Transfer of property. All books, records,
|
12 | | documents, property (real and personal), unexpended |
13 | | appropriations,
including both obligated and unobligated |
14 | | appropriations, and pending business pertaining to the rights, |
15 | | powers, duties, and
functions transferred to the Department |
16 | | under this Act shall be
transferred and delivered to the |
17 | | Department on
January 1, 2014, unless otherwise directed by the |
18 | | Governor. The Department is the successor agency of the State |
19 | | Board of Education, the State Superintendent of Education, the |
20 | | Board of Higher Education, and the Illinois Community College |
21 | | Board for purposes of Section 9b of the State Finance Act and |
22 | | the Successor Agency Act. |
23 | | Section 30. Rules, standards, and procedures. |
24 | | (a) The rules, standards, and procedures of the State Board |

Education, the State Superintendent of Education, the Board |
2 | | of Higher Education, or the Illinois Community College Board |
3 | | that are in effect on
December 31, 2013 and pertain to the |
4 | | rights, powers, duties, and
functions transferred to the |
5 | | Department under this Act shall become
the rules, standards, |
6 | | and procedures of the Department on January 1, 2014 and shall |
7 | | continue in effect until amended or repealed by the
Department.

8 | | (b) Any rules pertaining to the rights, powers, duties, and
|
9 | | functions transferred to the Department under this Act that |
10 | | have been
proposed by the State Board of Education, the State |
11 | | Superintendent of
Education, the Board of Higher Education, or |
12 | | the Illinois Community College Board but have not taken effect |
13 | | or been finally adopted or on before
December 31, 2013 shall |
14 | | become proposed rules of the Department on
January 1, 2014, and |
15 | | any rulemaking procedures that have
already been completed by |
16 | | the State Board of Education, the State
Superintendent of |
17 | | Education, the Board of Higher Education, or the Illinois |
18 | | Community College Board for those proposed rules need not be
|
19 | | repeated.
|
20 | | Section 35. Savings provisions. |
21 | | (a) The rights, powers, duties, and functions transferred |
22 | | to the
Department by this Act shall be vested in and exercised |
23 | | by the
Department subject to the provisions of this Act. An
act |
24 | | done by the Department or an officer, employee, or agent of the
|
25 | | Department in the exercise of the transferred rights, powers, |

functions shall have the same legal effect as if |
2 | | done by the State Board of
Education, the Board of Higher |
3 | | Education, or the Illinois Community College Board or an |
4 | | officer, employee, or agent of the State Board of

5 | | the Board of Higher Education, or the Illinois Community |
6 | | College Board.

7 | | (b) The transfer of rights, powers, duties, and functions |
8 | | to the
Department under this Act does not invalidate any
|
9 | | previous actions taken by or in respect to the State Board of |
10 | | Education, the Board of Higher Education, or the Illinois |
11 | | Community College Board
or its officers, employees, or agents. |
12 | | On January 1, 2014, references to the State Board of
Education, |
13 | | the Board of Higher Education, or the Illinois Community |
14 | | College Board or its officers, employees, or agents in any
|
15 | | document, contract, agreement, or law (other than this Act, |
16 | | Sections 1A-0.01, 1A-1, 1A-2, 1A-2.1, 1A-3.5, and 1A-4 of the |
17 | | School Code, Section 2 of the Board of Higher Education Act, |
18 | | and Section 2-1 of the Public Community College Act) shall, in |
19 | | appropriate contexts, be
deemed to refer to the Department or |
20 | | its officers, employees, or agents.

21 | | (c) The transfer of rights, powers, duties, and functions |
22 | | to the
Department under this Act does not affect any person's
|
23 | | rights, obligations, or duties, including any civil or criminal
|
24 | | penalties applicable thereto, arising out of those transferred |
25 | | rights,
powers, duties, and functions.

5 | | Superintendent of Education must, at a minimum, be appointed at |
6 | | the beginning of each term of a Governor after that Governor |
7 | | has made appointments to the Board. A performance-based
|
8 | | contract issued for the employment of a State Superintendent of
|
9 | | Education entered into on or after the effective date of this |
10 | | amendatory Act of the 93rd General Assembly must expire no |
11 | | later than February 1, 2007, and subsequent contracts must |
12 | | expire no later than February 1 each 4 years thereafter. No |
13 | | contract
shall be
extended or renewed beyond February 1, 2007 |
14 | | and February 1 each 4 years thereafter, but a State |
15 | | Superintendent of Education shall serve until his or her |
16 | | successor is appointed. Each contract entered into on or before |
17 | | January 8, 2007 with a State Superintendent of Education must |
18 | | provide that the State Board of Education may terminate the |
19 | | contract for cause, and the State Board of Education shall not |
20 | | thereafter be liable for further payments under the contract. |
21 | | With regard to this amendatory Act of the 93rd General |
22 | | Assembly, it is the intent of the General Assembly that, |
23 | | beginning with the Governor who takes office on the second |
24 | | Monday of January, 2007, a State Superintendent of Education be |
25 | | appointed at the beginning of each term of a Governor after |
26 | | that Governor has made appointments to the Board. The State

1 | | Superintendent of Education shall not serve as a member of the |
2 | | State
Board of Education , but . The Board shall set the |
3 | | compensation of the State

6 | | set by the Governor. The Board shall also establish the duties, |

duties delegated to the Office of |
2 | | Superintendent of Public Instruction on
January 12, 1975, |
3 | | except as the law providing for such powers and duties is

4 | | thereafter amended, and such other powers and duties as the |
5 | | General Assembly
shall designate. The Department Board shall be |
6 | | responsible for the educational policies
and guidelines for |
7 | | public schools, pre-school through grade
12 and Vocational |
8 | | Education in the State of Illinois. The Department Board shall
|
9 | | analyze the present and future aims, needs, and requirements of
|
10 | | education in the State of Illinois and recommend to the General |
11 | | Assembly
the powers which should be exercised by the Department |
12 | | Board . The Department Board shall
recommend the passage and the |
13 | | legislation necessary to determine the
appropriate |
14 | | relationship between the Department Board and local boards of |
15 | | education
and the various State agencies and shall recommend |
16 | | desirable
modifications in the laws which affect schools.

17 | | D. (Blank). Two members of the Board shall be appointed by |
18 | | the chairperson
to serve on a standing joint Education |
19 | | Committee, 2 others shall be
appointed from the Board of Higher |
20 | | Education, 2
others shall be appointed by the chairperson of |
21 | | the
Illinois Community College Board, and 2 others shall be |
22 | | appointed by the
chairperson of the Human Resource Investment |
23 | | Council. The
Committee shall be
responsible for making |
24 | | recommendations concerning the submission of any
workforce |
25 | | development plan or workforce training program required by |
26 | | federal
law or under any block grant authority. The Committee |

1 | | will be
responsible for developing policy on matters of mutual |
2 | | concern to
elementary, secondary and higher education such as |
3 | | Occupational and
Career Education, Teacher Preparation and |
4 | | Certification, Educational
Finance, Articulation between |
5 | | Elementary, Secondary and Higher Education
and Research and |
6 | | Planning. The joint Education Committee shall meet at
least |
7 | | quarterly and submit an annual report of its findings,
|
8 | | conclusions, and recommendations to the State Board of |
9 | | Education, the Board of
Higher Education, the Illinois |
10 | | Community College Board,
the Human Resource Investment |
11 | | Council, the Governor, and the
General
Assembly. All meetings |
12 | | of this Committee shall be official meetings for
reimbursement |
13 | | under this Act. On the effective date of this amendatory Act of |
14 | | the 95th General Assembly, the Joint Education Committee is |
15 | | abolished.
|
16 | | E. Five members of the State Board of Education Board shall |
17 | | constitute a quorum. A
majority
vote of the members appointed, |
18 | | confirmed and serving on the Board is
required to approve any |
19 | | action, except that the 7 new Board members who were appointed |
20 | | to fill seats of members whose terms were terminated on the |
21 | | effective date of this amendatory act of the 93rd General |
22 | | Assembly may vote to approve actions when appointed and |
23 | | serving.

24 | | Using the most recently available data, the Department of |
25 | | Education Board shall prepare and submit to the General |
26 | | Assembly and the
Governor on or before January 14, 2014 1976 |
|

1 | | and annually thereafter a report
or reports of its findings and |
2 | | recommendations. Such annual report shall
contain a separate |
3 | | section which provides a critique and analysis of the
status of |
4 | | education in Illinois and which identifies its specific |
5 | | problems
and recommends express solutions therefor.
Such |
6 | | annual report also shall contain the following information for |
7 | | the
preceding year ending on June 30: each act or omission of a |
8 | | school district
of which the Department State Board of |
9 | | Education has knowledge as a consequence of
scheduled, approved |
10 | | visits and which constituted a
failure by the district to |
11 | | comply with applicable State or federal laws or
regulations |
12 | | relating to public education, the name of such district, the |
13 | | date
or dates on which the Department State Board of Education |
14 | | notified the school district of
such act or omission, and what |
15 | | action, if any, the school district took with
respect thereto |
16 | | after being notified thereof by the Department State Board of |
17 | | Education.
The report shall also include the statewide high |
18 | | school dropout rate by
grade level, sex and race and the annual |
19 | | student dropout rate of and the
number of students who graduate |
20 | | from, transfer from or otherwise leave
bilingual programs. The |
21 | | Auditor General shall annually perform a
compliance audit of |
22 | | the Department State Board of Education's performance of the
|
23 | | reporting duty imposed by this amendatory Act of 1986. A |
24 | | regular system of
communication with other directly related |
25 | | State agencies shall be
implemented.
|
26 | | The requirement for reporting to the General Assembly shall |
|

by filing copies of the report with the Speaker, |
2 | | the Minority Leader and
the Clerk of the House of |
3 | | Representatives and the President, the Minority
Leader and the |
4 | | Secretary of the Senate and the Legislative Council, as |
5 | | required
by Section 3.1 of the General
Assembly Organization |
6 | | Act, and
filing such additional
copies with the State |
7 | | Government Report Distribution Center for the General
Assembly |
8 | | as is required under paragraph (t) of Section 7 of the State |
9 | | Library
Act.

10 | | F. Upon appointment of the 7 new Board members who were |
11 | | appointed to fill seats of members whose terms were terminated |
12 | | on the effective date of this amendatory Act of the 93rd |
13 | | General Assembly, the Board shall review all of its current |
14 | | rules in an effort to streamline procedures, improve |
15 | | efficiency, and eliminate unnecessary forms and paperwork.

6 | | terms of all members end. Except for references in this |
7 | | Section, beginning on January 1, 2014, references in this Act |
8 | | to the Board of Higher Education shall, in appropriate |
9 | | contexts, be deemed to refer to the Department of Education. |

23 | | (a) There is created the Illinois Community College Board

consist of 12 members as follows: a nonvoting student |
3 | | member selected by
the recognized advisory committee of |

College Board, this student |
5 | | to serve for a term of one year beginning on
July 1 of each |
6 | | year, except that the student member initially selected
shall |
7 | | serve a term beginning on the date of such selection and |
8 | | expiring on
the next succeeding June 30, and except that any |
9 | | student member or former
student member may be selected by the |
10 | | recognized advisory committee of
students of the State Board to |
11 | | serve a second term as the nonvoting student
member of the |
12 | | State Board; and 11 members, one of whom shall be a senior
|
13 | | citizen age 60 or over, to be appointed by the Governor by and |
14 | | with the
advice and consent of the Senate. Beginning on July 1, |
15 | | 2005, one of the 11 members appointed by the Governor, by and |
16 | | with the advice and consent of the Senate, must be a faculty |
17 | | member at an Illinois public community college. Also beginning |
18 | | on July 1, 2005, one of the 11 members appointed by the |
19 | | Governor, by and with the advice and consent of the Senate, |
20 | | must be a member of the board of trustees of a public community |
21 | | college district. The membership requirements set forth in this |
22 | | Section apply only to the State Board and shall have no effect |
23 | | on the membership of the board of trustees of a community |
24 | | college district. The members first appointed under this
|
25 | | amendatory Act of 1984 shall serve for a term of 6 years. After |
26 | | the
expiration of the terms of the office of the members first |

State Board, their respective successors shall |
2 | | hold office for a term of 6
years and until their successors |
3 | | are qualified and seated. In the event of
vacancies on the |

5 | | during a recess of the Senate, the Governor shall have the |
6 | | power to make
temporary appointments until the next meeting of |
7 | | the Senate, when the
vacancy shall be filled by nomination to |
8 | | be confirmed by the Senate.

9 | | (b) On January 1, 2014, the State Board is abolished and |
10 | | the terms of all members end. Except for references in this |
11 | | Section, beginning on January 1, 2014, references in this Act |
12 | | to the Illinois Community College Board shall, in appropriate |
13 | | contexts, be deemed to refer to the Department of Education. |
