Amends the Toll Highway Act. Provides that upon written approval by the Governor, the Toll Highway Authority may exercise any powers it has under the Toll Highway Act on the effective date of the amendatory Act to design and construct new railroad tracks. Provides that the Authority may charge an access fee to any passenger or freight rail operator who wishes to use tracks which the Authority has constructed using powers granted under the amendatory Act. Provides that moneys in the Road Fund may not be used to implement the new provisions. Provides that authorization must be granted to the Authority for each individual and distinct railroad track project. Effective immediately. |

2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:

4 | | Section 5. The Toll Highway Act is amended by adding |
5 | | Section 32.1 as follows: |
6 | | (605 ILCS 10/32.1 new) |
7 | | Sec. 32.1. Power to construct railroad tracks. Upon written |
8 | | approval by the Governor, the Authority may exercise any powers |
9 | | that exist under this Act on the effective date of this |
10 | | amendatory Act of the 97th General Assembly to design and |
11 | | construct new railroad tracks. The Authority may charge an |
12 | | access fee to any passenger or freight rail operator who wishes |
13 | | to use tracks which the Authority has constructed using the |
14 | | powers granted by this Section. Moneys in the Road Fund may not |
15 | | be used to implement this Section. Authorization must be |
