Amends the Illinois Vehicle Code. Provides that a Section concerning accident counseling shall apply to Class I and Class II (instead of only Class I) rail carriers. Provides that each Class I and Class II rail carrier must review and update its accident counseling or trauma program filing on an annual basis. Provides that programs may be filed either by mail or electronically via an email address designated by the Illinois Commerce Commission. Effective immediately.

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Vehicle Code is amended by changing |
5 | | Section 18c-7405 as follows:
|

7 | | Sec. 18c-7405. Accident counseling.
|
8 | | (a) Every Class I and Class II rail carrier, according to |
9 | | federal regulations,
operating in this State
must establish a |
10 | | counseling or trauma program and provide or make available
|
11 | | counseling or other critical incident stress debriefing |
12 | | services to each member
of an operating crew directly involved |
13 | | in an accident that results in loss of
life or serious bodily |
14 | | injury on its railway or right-of-way.

15 | | (b) Each Class I and Class II rail carrier, according to |
16 | | federal regulations,
operating in this State must file its |
17 | | counseling or trauma program
with the processing section of the |
18 | | Transportation Division of the Illinois
Commerce Commission, |
19 | | whose sole responsibility under this Section shall be to
|
20 | | receive the program and make it available
for public |
21 | | inspection. Each rail carrier subject to this subsection (b) |
22 | | must review and update its counseling or trauma program filing |
23 | | on an annual basis. Programs may be filed by mail or electronic |
