Amends the Illinois Municipal Code. Provides that the corporate authorities of any municipality may establish a database and require businesses located within the municipality to register with the municipality and be listed on the database. Provides that no registration fees shall be charged, and the database shall be a public record subject to The Freedom of Information Act. Further provides that a municipality may charge any business that fails to register a penalty of up to $200. Limits the concurrent exercise of home rule powers. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Municipal Code is amended by adding |
5 | | Section 11-1-12 as follows: |
6 | | (65 ILCS 5/11-1-12 new) |
7 | | Sec. 11-1-12. Registered businesses. The corporate |
8 | | authorities of any municipality may establish a database and |
9 | | require businesses located within the municipality to register |
10 | | with the municipality and be listed on the database. If a |
11 | | database is established, then the municipality shall not charge |
12 | | a registration fee for inclusion in the database. The corporate |
13 | | authorities of a municipality may charge a maximum penalty of |
14 | | $200 for failure to register with the municipality. The |
15 | | database shall be a public record subject to The Freedom of |
16 | | Information Act. This Section does not limit a home rule |
17 | | municipality's ability or grant a municipality the ability to |
18 | | collect licensing fees from businesses. This Section is a |
19 | | limitation under subsection (i) of Section 6 of Article VII of |
20 | | the Illinois Constitution on the concurrent exercise by home |
21 | | rule units of powers and functions exercised by the State.
