SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1414.1  from Ch. 95 1/2, par. 11-1414.1

    Amends the Illinois Vehicle Code. Provides that a multi-function school activity bus (MFSAB) may be used to transport students for any curriculum-related activity except for transportation from home to school or from school to home. Provides that a MFSAB authorized to transport students under the new provisions must be operated by a holder of a school bus driver permit and is subject to certain provisions concerning contractual student transfer arrangements, contracts requiring school bus driver permits, liability insurance, and safety testing. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-1414.1 as follows:
 
6    (625 ILCS 5/11-1414.1)  (from Ch. 95 1/2, par. 11-1414.1)
7    Sec. 11-1414.1. School transportation of students.
8    (a) Every student enrolled in grade 12 or below in any
9entity listed in subsection (a) of Section 1-182 of this Code
10must be transported in a school bus or a vehicle described in
11subdivision (1) or (2) of subsection (b) of Section 1-182 of
12this Code for any curriculum-related school activity, except a
13student may be transported in a multi-function school activity
14bus (MFSAB) as defined in Section 1-148.3a-5 of this Code for
15any curriculum-related activity except for transportation from
16home to school or from school to home, subject to the following
17conditions:
18        (i) A MFSAB may not be used to transport students under
19    this Section unless the driver holds a valid school bus
20    driver permit.
21        (ii) A MFSAB used to transport students under this
22    Section is subject to the requirements of Sections
23    6-106.11, 6-106.12, 12-707.01, 13-101, and 13-109 of this

1    Code. "Curriculum-related school activity" as used in this
2    subsection (a) includes transportation from home to school
3    or from school to home, tripper or shuttle service between
4    school attendance centers, transportation to a vocational
5    or career center or other trade-skill development site or a
6    regional safe school or other school-sponsored alternative
7    learning program, or a trip that is directly related to the
8    regular curriculum of a student for which he or she earns
9    credit.
10    (b) Every student enrolled in grade 12 or below in any
11entity listed in subsection (a) of Section 1-182 of this Code
12who is transported in a vehicle that is being operated by or
13for a public or private primary or secondary school, including
14any primary or secondary school operated by a religious
15institution, for an interscholastic, interscholastic-athletic,
16or school-sponsored, noncurriculum-related activity that (i)
17does not require student participation as part of the
18educational services of the entity and (ii) is not associated
19with the students' regular class-for-credit schedule shall
20transport students only in a school bus or vehicle described in
21subsection (b) of Section 1-182 of this Code. This subsection
22(b) does not apply to any second division vehicle used by an
23entity listed in subsection (a) of Section 1-182 of this Code
24for a parade, homecoming, or a similar noncurriculum-related
25school activity.
