2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Illinois Pension Code is amended by changing | ||||||||||||||||||||||||
5 | Sections 1-114, 1-135, 5-178, 6-174, 8-192, 9-185, 11-181, | ||||||||||||||||||||||||
6 | 12-156, 17-137, 17-138, and 17-139 as follows:

8 | Sec. 1-114. Liability for Breach of Fiduciary Duty. (a) Any | ||||||||||||||||||||||||
9 | person who is a fiduciary with respect to a retirement system | ||||||||||||||||||||||||
10 | or
pension fund established under this Code who breaches any | ||||||||||||||||||||||||
11 | duty
imposed upon fiduciaries by this Code , including, but not | ||||||||||||||||||||||||
12 | limited to, a failure to report a reasonable suspicion of a | ||||||||||||||||||||||||
13 | false statement specified in Section 1-135 of this Code, shall | ||||||||||||||||||||||||
14 | be personally liable to make
good to such retirement system or | ||||||||||||||||||||||||
15 | pension fund any losses to it resulting
from each such breach, | ||||||||||||||||||||||||
16 | and to restore to such retirement system or pension
fund any | ||||||||||||||||||||||||
17 | profits of such fiduciary which have been made through use of | ||||||||||||||||||||||||
18 | assets
of the retirement system or pension fund by the | ||||||||||||||||||||||||
19 | fiduciary, and shall be
subject to such equitable or remedial | ||||||||||||||||||||||||
20 | relief as the court may deem appropriate,
including the removal | ||||||||||||||||||||||||
21 | of such fiduciary.
| ||||||||||||||||||||||||
22 | (b) No person shall be liable with respect to a breach of | ||||||||||||||||||||||||
23 | fiduciary duty
under this Code if such breach occurred before |

1 | such person became a fiduciary
or after such person ceased to | ||||||
2 | be a fiduciary.

| ||||||
5 | Sec. 1-135. Fraud. Any person who knowingly makes any false | ||||||
6 | statement or falsifies or permits to be falsified any record of | ||||||
7 | a retirement system or pension fund created under this Code or | ||||||
8 | the Illinois State Board of Investment in an attempt to defraud | ||||||
9 | the retirement system or pension fund created under this Code | ||||||
10 | or the Illinois State Board of Investment is guilty of a Class | ||||||
11 | 3 felony. Any reasonable suspicion by any appointed or elected | ||||||
12 | commissioner, trustee, director, board member, or employee of a | ||||||
13 | retirement system or pension fund created under this Code or | ||||||
14 | the State Board of Investment of a false statement or falsified | ||||||
15 | record being submitted or permitted by a person under this Code | ||||||
16 | shall be immediately referred to the board of trustees of a | ||||||
17 | retirement system or pension fund created under this Code or | ||||||
18 | the State Board of Investment or the State's Attorney of the | ||||||
19 | jurisdiction where the alleged fraudulent activity occurred. | ||||||
20 | The board of trustees of a retirement system or pension fund | ||||||
21 | created under this Code or the State Board of Investment shall | ||||||
22 | immediately notify the State's Attorney of the jurisdiction | ||||||
23 | where any alleged fraudulent activity occurred for | ||||||
24 | investigation.

annuitant of the fund, or a pensioner of any | ||||||
14 | prior police pension fund
in operation, by authority of law, in | ||||||
15 | the city. Children less than age
18 shall not be eligible for | ||||||
16 | board membership. The term of office for
all members shall be 3 | ||||||
17 | years. For the election to be held in 2008 only, the terms for | ||||||
18 | the member who is a lieutenant or of a rank superior to | ||||||
19 | lieutenant and the member who is a sergeant shall be 3 years | ||||||
20 | and the terms for the member who is an investigator or a rank | ||||||
21 | inferior to that rank and the annuitant member shall be 4 | ||||||
22 | years. After the terms of the 2008 election are completed, the | ||||||
23 | terms revert to 3-year terms for each elected trustee. Upon his | ||||||
24 | election, the member holding the
rank of investigator or a rank | ||||||
25 | inferior to that rank shall be detailed by
the Police |

1 | Superintendent to the office of the board for the duration of
| ||||||
2 | his term as trustee.
| ||||||
3 | The members of a retirement board holding office in a city | ||||||
4 | at the
time this Article becomes effective, including elected, | ||||||
5 | appointed and
ex-officio members, shall continue in office | ||||||
6 | until the expiration of
their respective terms or appointment | ||||||
7 | and until their respective
successors are elected or appointed, | ||||||
8 | and qualified.

9 | At least 30 days prior to the expiration of the term of | ||||||

each appointive member the mayor shall appoint a | ||||||
11 | successor for a term of
3 years.

12 | The board shall conduct a regular election at least 30 days | ||||||

24 | board who was chosen from the retired members of
such fund | ||||||
25 | shall become members of the board as follows:

1 | (a) The active fireman member for whom the highest number | ||||||
2 | of votes was
cast and counted at the most recent election for | ||||||
3 | board members shall become
a member of the retirement board for | ||||||
4 | a term which shall end on December 1st
of the third year after | ||||||
5 | the year in which this Article comes into force in
the city; | ||||||
6 | the member of the board for whom the second highest number of
| ||||||
7 | votes was cast and counted at such election shall become a | ||||||
8 | member of the
retirement board for a term which shall end on | ||||||
9 | December 1st of the second
year after the year in which this | ||||||
10 | Article comes into force in the city; and
the member of the | ||||||
11 | board for whom the third highest number of votes was cast
and | ||||||
12 | counted at such election shall become a member of the | ||||||
13 | retirement board
for a term which shall end on December 1st of | ||||||
14 | the first year after the year
in which this Article comes into | ||||||
15 | force in the city.

16 | (b) The annuitant member of the pension fund shall become a | ||||||
17 | member of
the board for a term which shall end on December 1st | ||||||
18 | of the second year
after the year in which this Article comes | ||||||
19 | into force in the city.
| ||||||
20 | The board shall conduct regular elections annually, at | ||||||
21 | least 30 days
prior to the expiration of the term of the active | ||||||
22 | fireman member of the
board whose term next expires, for the | ||||||
23 | election of a successor for a term
of 3 years. The board also | ||||||
24 | shall conduct regular elections biennially, at
least 30 days | ||||||
25 | prior to the expiration of the term of the member who is a
| ||||||
26 | pensioner of any pension fund formerly in effect in such city |
| |||||||
| |||||||
1 | or an
annuitant of the annuity and benefit fund herein | ||||||
2 | provided, for the election
of a successor to such member for a | ||||||
3 | term of 2 years.

4 | Any member of the board, elected as aforesaid, shall | ||||||
5 | continue in office
until his successor is elected and | ||||||
6 | qualified.
| ||||||
7 | Each member of the board, before entering upon the duties | ||||||
8 | of his office,
shall take the oath prescribed by the | ||||||
9 | Constitution of this State, which
oath shall be filed in the | ||||||
10 | office of the city clerk of the city.

11 | Notwithstanding any other provision of this Section, the | ||||||
12 | term of any person appointed or elected under this Section | ||||||
13 | before the effective date of this amendatory Act of the 97th | ||||||

24 | appointed by the comptroller of such county, who may be the
| ||||||
25 | comptroller or some person chosen by him from among employees |
| |||||||
| |||||||
1 | of the county,
who are
versed in the affairs of the | ||||||
2 | comptroller's office; and one member shall be
appointed by the | ||||||
3 | treasurer of such county, who may be the treasurer or some
| ||||||
4 | person chosen by him from among employees of the County who are | ||||||
5 | versed in
the affairs of the treasurer's office.
| ||||||
6 | The member appointed by the comptroller shall hold office | ||||||
7 | for a term
ending on December 1st of the first year following | ||||||
8 | the year of appointment.
The member appointed by the county | ||||||
9 | treasurer shall hold office for a term
ending on December 1st | ||||||
10 | of the second year following the year of appointment.
| ||||||
11 | Thereafter, each appointed member shall be appointed by the | ||||||
12 | officer that
appointed his predecessor for a term of 2 years.
| ||||||
13 | Notwithstanding any other provision of this Section, the | ||||||
14 | term of any person appointed under this subsection (b) expires | ||||||
15 | 90 days after the effective date of this amendatory Act of the | ||||||
16 | 97th General Assembly. | ||||||
17 | (c) Until 90 days after the effective date of this | ||||||
18 | amendatory Act of the 97th General Assembly, 3 Three county | ||||||
19 | employee members of the board shall be
elected as follows: | ||||||
20 | within 30 days from and after the date upon which this
Article | ||||||
21 | comes into effect in the county, the clerk of the county shall
| ||||||
22 | arrange for and hold an election. One employee shall be elected | ||||||
23 | for a term
ending on the first day in the month of December of | ||||||
24 | the first year next
following the effective date; one for a | ||||||
25 | term ending on December 1st of the
following year; and one for | ||||||
26 | a term ending December 1st of the second following
year. |

| ||||||
11 | under this Article shall be eligible to vote and be elected. | ||||||
12 | Each such
member shall be elected to a term ending on the first | ||||||

December of the third following year. | ||||||
14 | Notwithstanding any other provision of this Section, the | ||||||
15 | term of any person elected under this subsection expires 90 | ||||||
16 | days after the effective date of this amendatory Act of the | ||||||
17 | 97th General Assembly.

18 | (d-1) Beginning December 1, 2001, and every 3 years | ||||||
19 | thereafter until 90 days after the effective date of this | ||||||
20 | amendatory Act of the 97th General Assembly , an
annuitant | ||||||
21 | member of the board shall be elected as follows:
the board | ||||||
22 | shall arrange for and hold an election in which only those
| ||||||
23 | participants who are currently receiving retirement benefits
| ||||||
24 | under this Article shall be eligible to vote and be elected. | ||||||
25 | Each such
member shall be elected to a term ending on the first | ||||||
26 | day in the month of
December of the third following year. Until |

created under this subsection | ||||||
2 | (d-1) may be filled by the board as in the case
of a vacancy.

3 | Notwithstanding any other provision of this Section, the | ||||||

5 | days after the effective date of this amendatory Act of the | ||||||
6 | 97th General Assembly. | ||||||
7 | (e) Beginning December 1, 1988 and until 90 days after the | ||||||
8 | effective date of this amendatory Act of the 97th General | ||||||
9 | Assembly , if a Forest Preserve District Employees'
Annuity and | ||||||
10 | Benefit Fund shall be in force in such county and the board of
| ||||||
11 | this fund is charged with administering the affairs of such | ||||||
12 | annuity and
benefit fund for employees of such forest preserve | ||||||
13 | district, a forest
preserve district member of the board shall | ||||||
14 | be elected as of December 1, 1988,
and every 3 years thereafter | ||||||
15 | as follows: the board shall arrange for and
hold an election in | ||||||
16 | which only those employees of such forest preserve
district who | ||||||
17 | are contributors to the annuity and benefit fund for employees
| ||||||
18 | of such forest preserve district shall be eligible to vote and | ||||||
19 | be elected.
