1 | | AN ACT concerning service dogs.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The School Code is amended by changing Section |
5 | | 14-6.02 as follows:
|
6 | | (105 ILCS 5/14-6.02) (from Ch. 122, par. 14-6.02)

7 | | Sec. 14-6.02. Service animals. Service animals such as |
8 | | guide dogs,
signal dogs or any other animal individually |
9 | | trained to perform tasks for
the benefit of a student with a |
10 | | disability shall be permitted to accompany
that student at all |
11 | | school functions, whether in or outside the classroom. For the |
12 | | purposes of this Section, "service animal" has the same meaning |
13 | | as in Section 1 of the Service Animal Access Act.

1 | | Sec. 0.01. Short title. This Act may be cited as the

2 | | Service Animal Guide Dog Access Act.

5 | | Sec. 1.
When a blind, hearing impaired or physically |
6 | | handicapped
person with a physical, mental, or intellectual |
7 | | disability requiring the use of a service animal or a person |
8 | | who is subject to epilepsy or other seizure disorders is
|
9 | | accompanied by a service animal a dog which serves as a guide, |
10 | | leader, seizure-alert, or
seizure-response dog for such person |
11 | | or when a trainer of a service animal guide, leader,
|
12 | | seizure-alert, or seizure-response dog is accompanied by a |
13 | | service animal guide, leader,
seizure-alert, or |
14 | | seizure-response dog or a dog that is being trained to be a
|
15 | | guide, leader, seizure-alert, or seizure-response dog , neither |
16 | | the person nor
the service animal dog shall be denied the right |
17 | | of entry and use of facilities of any public
place of |
18 | | accommodation as defined in Section 5-101 of the " Illinois |
19 | | Human
Rights Act ", if such dog is wearing a harness and such |
20 | | person presents
credentials for inspection issued by a school |
21 | | for training guide, leader,
seizure-alert, or seizure-response |
22 | | dogs .

23 | | For the purposes of this Section, "service animal" means a |
24 | | dog or miniature horse trained or being trained as a hearing |
25 | | animal, a guide animal, an assistance animal, a seizure alert |

1 | | animal, a mobility animal, a psychiatric service animal, an |
2 | | autism service animal, or an animal trained for any other |
3 | | physical, mental, or intellectual disability. "Service animal" |
4 | | includes a miniature horse that a public
place of accommodation |
5 | | shall make reasonable accommodation so long as the public
place |
6 | | of accommodation takes into consideration: (1) the type, size |
7 | | and weight of the miniature horse and whether the facility can |
8 | | accommodate its features; (2) whether the handler has |
9 | | sufficient control of the miniature horse; (3) whether the |
10 | | miniature horse is housebroken; and (4) whether the miniature |
11 | | horse's presence in the facility compromises legitimate safety |
12 | | requirements necessary for operation. |
13 | | Any violation of this Act is a Class C misdemeanor.
