1 | | amendatory Act of the 97th General Assembly, each statutorily |
2 | | created board or commission not subject to subsection (g) shall |
3 | | report to the Secretary of State on that board's or |
4 | | commission's last meeting prior to the effective date of this |
5 | | amendatory Act of the 97th General Assembly, and the report |
6 | | shall include the date, time, and location of the meeting. |
7 | | (c) Within 60 days after the 30-day period set forth in |
8 | | subsection (b), the Secretary of State shall submit a report to |
9 | | the Governor, the Secretary of the Senate, and the Clerk of the |
10 | | House of Representatives, listing all statutorily created |
11 | | boards and commissions that have not met in the 2 years |
12 | | immediately preceding the effective date of this amendatory Act |
13 | | of the 97th General Assembly. If a board or commission not |
14 | | subject to subsection (g) does not report to the Secretary of |
15 | | State pursuant to this subsection, then it shall be deemed to |
16 | | be inactive and subject to the provisions of subsections (d) |
17 | | and (e). |
18 | | (d) Unless the Governor acts pursuant to subsection (e), if |
19 | | a board or commission has not met at least once during the 2 |
20 | | years prior to the effective date of this amendatory Act of the |
21 | | 97th General Assembly and is reported as inactive pursuant to |
22 | | subsection (b), then the board or commission is dissolved at |
23 | | the end of the 75-day period set forth in subsection (e). |
24 | | (e) Within 75 days after the Governor's receipt of the |
25 | | report submitted by the Secretary of State under subsection |
26 | | (c), the Governor may prevent the dissolution of any inactive |

1 | | board or commission by filing a written statement with the |
2 | | Secretary of State and the Senate that authorizes the continued |
3 | | existence of the board or commission and provides a rationale |
4 | | for why the board or commission needs to exist. Before the |
5 | | expiration of the 75-day period set forth in this subsection, |
6 | | each board or commission may request that the Governor prevent |
7 | | the dissolution of the board or commission in accordance with |
8 | | this subsection. |
9 | | (f) Within 14 days after the 75-day period set forth in |
10 | | subsection (e), the Governor shall publish a list of all boards |
11 | | and commissions dissolved under subsection (d). The |
12 | | Legislative Reference Bureau shall prepare for introduction no |
13 | | later than in the annual session of the General Assembly next |
14 | | occurring after the list is published by the Governor a |
15 | | revisory bill effecting such changes in the statutes as may be |
16 | | necessary to conform the statutes to the changes in law made by |
17 | | the dissolution of the boards and commissions included in the |
18 | | list published by the Governor. The failure of the General |
19 | | Assembly to enact such a bill does not affect the validity of |
20 | | the dissolution of any board or commission under this Section. |
21 | | (g) Any board or commission created after July 1, 2010 is |
22 | | exempt from this Section.

23 | | Section 99. Effective date. This Act takes effect upon |
24 | | becoming law.".
