AMENDMENT TO HOUSE BILL 3816

2    AMENDMENT NO. ______. Amend House Bill 3816, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Gubernatorial Boards and Commissions Act is
6amended by adding Section 25 as follows:
 
7    (15 ILCS 50/25 new)
8    Sec. 25. Dissolution of inactive boards and commissions.
9    (a) Within 10 days after the effective date of this
10amendatory Act of the 97th General Assembly, the Governor shall
11make reasonable efforts to notify each statutorily created
12board or commission of (i) the reporting requirement imposed
13under subsection (b), and (ii) the right of the board or
14commission to request that the Governor prevent the dissolution
15of the board or commission under subsection (e).
16    (b) Within 30 days after the effective date of this

1amendatory Act of the 97th General Assembly, each statutorily
2created board or commission not subject to subsection (g) shall
3report to the Secretary of State on that board's or
4commission's last meeting prior to the effective date of this
5amendatory Act of the 97th General Assembly, and the report
6shall include the date, time, and location of the meeting.
7    (c) Within 60 days after the 30-day period set forth in
8subsection (b), the Secretary of State shall submit a report to
9the Governor, the Secretary of the Senate, and the Clerk of the
10House of Representatives, listing all statutorily created
11boards and commissions that have not met in the 2 years
12immediately preceding the effective date of this amendatory Act
13of the 97th General Assembly. If a board or commission not
14subject to subsection (g) does not report to the Secretary of
15State pursuant to this subsection, then it shall be deemed to
16be inactive and subject to the provisions of subsections (d)
17and (e).
18    (d) Unless the Governor acts pursuant to subsection (e), if
19a board or commission has not met at least once during the 2
20years prior to the effective date of this amendatory Act of the
2197th General Assembly and is reported as inactive pursuant to
22subsection (b), then the board or commission is dissolved at
23the end of the 75-day period set forth in subsection (e).
24    (e) Within 75 days after the Governor's receipt of the
25report submitted by the Secretary of State under subsection
26(c), the Governor may prevent the dissolution of any inactive

1board or commission by filing a written statement with the
2Secretary of State and the Senate that authorizes the continued
3existence of the board or commission and provides a rationale
4for why the board or commission needs to exist. Before the
5expiration of the 75-day period set forth in this subsection,
6each board or commission may request that the Governor prevent
7the dissolution of the board or commission in accordance with
8this subsection.
9    (f) Within 14 days after the 75-day period set forth in
10subsection (e), the Governor shall publish a list of all boards
11and commissions dissolved under subsection (d). The
12Legislative Reference Bureau shall prepare for introduction no
13later than in the annual session of the General Assembly next
14occurring after the list is published by the Governor a
15revisory bill effecting such changes in the statutes as may be
16necessary to conform the statutes to the changes in law made by
17the dissolution of the boards and commissions included in the
18list published by the Governor. The failure of the General
19Assembly to enact such a bill does not affect the validity of
20the dissolution of any board or commission under this Section.
21    (g) Any board or commission created after July 1, 2010 is
22exempt from this Section.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.".
