Amends the Long-Term Care Provider Funding Article of the Illinois Public Aid Code. Provides that the assessment imposed on long-term care providers in relation to the number of occupied bed days shall not be billed or passed on to any resident of a nursing home operated by the nursing home provider (rather than may not be added
to the charges of an individual's nursing home care that is paid for in
whole, or in part, by a federal, State, or combined federal-state medical
care program, except those individuals receiving Medicare Part B benefits
solely). Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | changing Section 5B-2 as follows:
|
6 | | (305 ILCS 5/5B-2) (from Ch. 23, par. 5B-2)

7 | | Sec. 5B-2. Assessment; no local authorization to tax.
|
8 | | (a) For the privilege of engaging in the occupation of |
9 | | long-term care
provider, an assessment is imposed upon each |
10 | | long-term care provider for
the State fiscal year beginning on |
11 | | July 1, 1992 and ending on June 30,
1993, in an amount equal to |
12 | | $6.30 times the number of occupied bed days for
the most recent |
13 | | calendar year ending before the beginning of that State
fiscal |
14 | | year. Notwithstanding any provision of any other Act to the
|
15 | | contrary, this assessment shall be construed as a tax, but |
16 | | shall not be billed or passed on to any resident of a nursing |
17 | | home operated by the nursing home provider may not be added
to |
18 | | the charges of an individual's nursing home care that is paid |
19 | | for in
whole, or in part, by a federal, State, or combined |
