SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/21-9  from Ch. 122, par. 21-9

    Amends the School Code. With respect to the issuance of substitute teacher's certificates, provides that a person who holds a bachelor of arts degree from an institution of higher learning accredited by the North Central Association or other comparable regional accrediting association or has been graduated from a recognized institution of higher learning with a bachelor's degree must also complete a 15-hour substitute authorization program approved by the State Board of Education. Sets forth required components of the program.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
521-9 as follows:
 
6    (105 ILCS 5/21-9)  (from Ch. 122, par. 21-9)
7    Sec. 21-9. Substitute certificates and substitute
8teaching.
9    (a) A substitute teacher's certificate may be issued for
10teaching in all grades of the common schools. Such certificate
11may be issued upon request of the regional superintendent of
12schools of any region in which the teacher is to teach. A
13substitute teacher's certificate is valid for teaching in the
14public schools of any county. Such certificate may be issued to
15persons who either (a) hold a certificate valid for teaching in
16the common schools as shown on the face of the certificate, (b)
17have completed a 15-hour substitute authorization program
18approved by the State Board of Education and either hold a
19bachelor of arts degree from an institution of higher learning
20accredited by the North Central Association or other comparable
21regional accrediting association or have been graduated from a
22recognized institution of higher learning with a bachelor's
23degree, or (c) have had 2 years of teaching experience and meet

1such other rules and regulations as may be adopted by the State
2Board of Education in consultation with the State Teacher
3Certification Board.
4    An approved substitute authorization program shall consist
5of all of the following components:
6        (1) Classroom management. This component includes an
7    understanding of individual and group motivation and
8    behavior to create a learning environment that encourages
9    positive social interaction, active engagement in
10    learning, and self-motivation.
11        (2) Strategies for learning. This component includes
12    understanding and using a variety of learning strategies to
13    encourage students' development of critical thinking,
14    problem solving, and performance skills.
15        (3) Diversity. This component includes understanding
16    how students differ in their approaches to learning and
17    creating learning opportunities that are equitable and are
18    adaptable to diverse learners.
19        (4) Ethics. This component includes fostering
20    relationships with parents, school colleagues, and
21    organizations in the larger community to support students'
22    learning and development and to be aware of the State Board
23    of Education's rules of professional practice and
24    competent performance.
25The cost of attending a substitute authorization program must
26be paid by the person attending the program. The State Board of

1Education may adopt rules concerning substitute authorization
2programs.
3    A substitute teacher's Such certificate shall expire on
4June 30 in the fourth year from date of issue. Persons who have
5completed a substitute authorization program are not required
6to retake the program in order to renew their certificate.
7Substitute teacher's certificates are not subject to
8endorsement as described in Section 21-1b of this Code.
9    (b) A teacher holding a substitute teacher's certificate
10may teach only in the place of a certified teacher who is under
11contract with the employing board and may teach only when no
12appropriate fully certified teacher is available to teach in a
13substitute capacity. A teacher holding an early childhood
14certificate, an elementary certificate, a high school
15certificate, or a special certificate may also substitute teach
16in grades K-12 but only in the place of a certified teacher who
17is under contract with the employing board. A substitute
18teacher may teach only for a period not to exceed 90 paid
19school days or 450 paid school hours in any one school district
20in any one school term. However, a teacher holding an early
21childhood, elementary, high school, or special certificate may
22substitute teach for a period not to exceed 120 paid school
23days or 600 paid school hours in any one school district in any
24one school term. Where such teaching is partly on a daily and
25partly on an hourly basis, a school day shall be considered as
265 hours. The teaching limitations imposed by this subsection

1upon teachers holding substitute certificates shall not apply
2in any school district operating under Article 34.
3    (c) In order to substitute teach in the public schools, a
4person holding a valid substitute teacher's certificate or a
5person holding a valid early childhood certificate, a valid
6elementary certificate, a valid high school certificate, or a
7valid special certificate shall register as a substitute
8teacher with the regional superintendent of schools in each
9educational service region where the person will be employed. A
10person who registers as a substitute teacher with the regional
11superintendent of schools is responsible for (1) the payment of
12fees to register the certificate for its period of validity,
13(2) authorization of a criminal history records check and
14checks of the Statewide Sex Offender Database and Statewide
15Child Murderer and Violent Offender Against Youth Database, as
16provided in Section 10-21.9 of this Code, (3) payment of the
17cost of the criminal history records check and checks of the
18Statewide Sex Offender Database and Statewide Child Murderer
19and Violent Offender Against Youth Database, and (4) providing
20evidence of physical fitness and freedom from communicable
21disease, including tuberculosis, which may consist of a
22physical examination and a tuberculin skin test as required by
23Section 24-5 of this Code.
24    The regional superintendent of schools shall maintain a
25file for each registered substitute teacher in the educational
26service region that includes a copy of the person's

1certificate, the results from the criminal history records
2check and checks of the Statewide Sex Offender Database and
3Statewide Child Murderer and Violent Offender Against Youth
4Database, a copy of the physical examination, and a copy of the
5tuberculin skin test. The regional superintendent of schools
6shall issue a signed and sealed certificate of authorization to
7the substitute teacher that verifies that the substitute
8teacher has completed the registration process and criminal
9history records check and checks of the Statewide Sex Offender
10Database and Statewide Child Murderer and Violent Offender
11Against Youth Database and has a physical examination and
12negative tuberculin test on file with the regional
13superintendent of schools and is thereby approved to substitute
14teach in the public schools of the educational service region.
15This certificate must be presented to all prospective employing
16school districts in the educational service region, who shall
17photocopy the certificate and keep a copy of the certificate
18with employment records for the substitute teacher.
19    Persons wishing to substitute teach in more than one
20educational service region shall register as a substitute
21teacher with the appropriate regional superintendent of
22schools. The registration process shall include all items
23listed in the first paragraph of this subsection (b), with the
24exception of the authorization of a criminal history records
25check and checks of the Statewide Sex Offender Database and
26Statewide Child Murderer and Violent Offender Against Youth

1Database and the accompanying payment of associated fees. If
2the substitute teacher has been issued a signed and sealed
3certificate of authorization from another regional
4superintendent of schools, the registering entity may
5photocopy the certificate for its files and verify the
6substitute teacher's registration status.
