2 | | AMENDMENT NO. ______. Amend House Bill 3414 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 1. Short title. This Act may be cited as the |
5 | | Illinois Main Street Act. |
6 | | Section 5. Legislative purpose. The General Assembly makes |
7 | | the following findings: |
8 | | (1) The continued economic vitality of downtown and |
9 | | neighborhood commercial districts in our municipalities is |
10 | | essential to community preservation, social cohesion, and |
11 | | economic growth. |
12 | | (2) Municipalities need to maintain their local |
13 | | economies so that business owners will be able to provide |
14 | | goods and services to the community, to provide employment |
15 | | opportunities, to avoid disinvestment and economic |
16 | | dislocations, and to develop and sustain downtown and |

1 | | neighborhood commercial district revitalization programs |
2 | | to address these problems. |
3 | | Section 10. Definitions. As used in this Act: |
4 | | "Department" means the Department of Commerce and Economic |
5 | | Opportunity. |
6 | | "Director" means the Director of Commerce and Economic |
7 | | Opportunity. |
8 | | "Program" means the Illinois Main Street Program. |
9 | | Section 15. Illinois Main Street Program. The Illinois Main |
10 | | Street Program is created within the Department. In order to |
11 | | implement the Illinois Main Street Program, the Department |
12 | | shall do all of the following: |
13 | | (1) Provide assistance to municipalities designated as |
14 | | Main Street Communities, municipalities interested in |
15 | | becoming designated through the program, and businesses, |
16 | | property owners, organizations, and municipalities |
17 | | undertaking a comprehensive downtown or neighborhood |
18 | | commercial district revitalization initiative and |
19 | | management strategy. Assistance may include, but is not |
20 | | limited to, initial site evaluations and assessments, |
21 | | training for local programs, training for local program |
22 | | staff, site visits and assessments by technical |
23 | | specialists, local program design assistance and |
24 | | evaluation, and continued local program on-site |

1 | | assistance. |
2 | | (2) To the extent funds are made available, provide |
3 | | financial assistance to municipalities or local |
4 | | organizations to assist in initial downtown or |
5 | | neighborhood commercial district revitalization program |
6 | | specialized training, specific project feasibility |
7 | | studies, market studies, and design assistance. |
8 | | (3) Operate the Illinois Main Street Program in |
9 | | accordance with the plan developed by the Department. |
10 | | (4) Consider other factors the Department deems |
11 | | necessary for the implementation of this Act. |
12 | | Section 20. Main Street Community designation. |
13 | | (a) The Department shall adopt criteria for the designation |
14 | | of a Main Street Community. In establishing the criteria, the |
15 | | Department shall consider all of the following: |
16 | | (1) The degree of interest and commitment to |
17 | | comprehensive downtown or neighborhood commercial district |
18 | | revitalization and, where applicable, historic |
19 | | preservation by both the public and private sectors. |
20 | | (2) The evidence of potential private sector |
21 | | investment in the downtown or neighborhood commercial |
22 | | district. |
23 | | (3) Where applicable, a downtown or neighborhood |
24 | | commercial district with sufficient historic fabric to |
25 | | become a foundation for an enhanced community image. |

1 | | (4) The capacity of the organization to undertake a |
2 | | comprehensive program and the financial commitment to |
3 | | implement a long-term downtown or neighborhood commercial |
4 | | district revitalization program that includes a commitment |
5 | | to employ a professional program manager. |
6 | | (5) The National Main Street Center's criteria for |
7 | | designating official main street municipalities. |
8 | | (6) Other factors the Department deems necessary for |
9 | | the designation of a local program. |
10 | | (b) Illinois Main Street shall designate local downtown or |
11 | | neighborhood commercial district revitalization programs and |
12 | | official local main street programs. |
13 | | (c) The Department must approve all local downtown or |
14 | | neighborhood commercial district revitalization program |
15 | | boundaries. The boundaries of a local downtown or neighborhood |
16 | | commercial district revitalization program are typically |
17 | | defined using the pedestrian core of a traditional commercial |
18 | | district. |
19 | | Section 25. Illinois Main Street Plan. The Department |
20 | | shall, in consultation with the Lieutenant Governor, develop a |
21 | | plan for the Illinois Main Street Program. The plan shall |
22 | | describe: |
23 | | (1) the objectives and strategies of the Illinois Main |
24 | | Street Program; |
25 | | (2) how the Illinois Main Street Program will be |

1 | | coordinated with existing federal, state, local, and |
2 | | private sector business development and historic |
3 | | preservation efforts; |
4 | | (3) the means by which private investment will be |
5 | | solicited and employed; |
6 | | (4) the methods of selecting and providing assistance |
7 | | to participating local programs; and |
8 | | (5) a means to solicit private contributions for State |
9 | | and local operations of the Illinois Main Street Program. |
10 | | Section 30. Role of the Lieutenant Governor. The Lieutenant |
11 | | Governor shall be the Ambassador of the Illinois Main Street |
12 | | Program. The Department shall advise and consult with the |
13 | | Lieutenant Governor on the activities of the Illinois Main |
14 | | Street Program. The Lieutenant Governor, with the assistance of |
15 | | the Department, shall promote and encourage the success of the |
16 | | Illinois Main Street Program. |
17 | | Section 35. Illinois Main Street Fund. The Illinois Main |
18 | | Street Fund is created as a special fund in the State treasury. |
19 | | All receipts from private contributions, federal funds, |
20 | | legislative appropriations, and fees for services, if levied, |
21 | | must be deposited into the Fund. Subject to appropriation, |
22 | | expenditures from the Fund may be used only for the benefit of |
23 | | the Illinois Main Street Program. |

1 | | Section 90. The Green Governments Illinois Act is amended |
2 | | by changing Sections 15, 35, and 45 as follows: |

4 | | Sec. 15. Composition of the Council. The Council shall be |
5 | | composed comprised of representatives from various State |
6 | | agencies and State universities with specific fiscal, |
7 | | procurement, educational, and environmental policy expertise. |
8 | | Until the effective date of this amendatory Act of the 97th |
9 | | General Assembly, the The Lieutenant Governor is the chair of |
10 | | the Council . On and after the effective date of this amendatory |
11 | | Act of the 97th General Assembly, the Governor is the chair of |
12 | | the Council, and the Lieutenant Governor, or his or her |
13 | | designee, shall be a member of the council . The director or |
14 | | President, respectively, of each of the following State |
15 | | agencies and State universities, or his or her designee, is a |
16 | | member of the Council: the Department of Commerce and Economic |
17 | | Opportunity, the Environmental Protection Agency, the |
18 | | University of Illinois, the Department of Natural Resources, |
19 | | the Department of Central Management Services, the Governor's |
20 | | Office of Management and Budget, the Department of Agriculture, |
21 | | the Department of Transportation, the Department of |
22 | | Corrections, the Department of Human Services, the Department |
23 | | of Public Health, the State Board of Education, the Board of |
24 | | Higher Education, and the Capital Development Board. The Office |
25 | | of the Lieutenant Governor shall provide administrative |

1 | | support to the Council. A minimum of one staff position in the |
2 | | Office of the Lieutenant Governor shall be dedicated to the |
3 | | Green Governments Illinois program.

7 | | Sec. 35. Environmental Plans and Reporting. |
8 | | (a) Each State agency shall submit an annual adopted |
9 | | environmental sustainability plan to the chairman of the |
10 | | Council for review and approval on or before April 1, 2008 and |
11 | | each April 1 thereafter . |
12 | | On or before November 1, 2007, the Council shall prepare a |
13 | | downloadable plan template designed to provide a simple |
14 | | framework for the development of an environmental |
15 | | sustainability plan as required by this Act. The Council shall |
16 | | adopt procedures for reviewing and approving the plans, and |
17 | | make staff available during preparation of the plans to assist |
18 | | State agencies with their plan-writing efforts. The Council |
19 | | shall complete its plan review process on or before June 1, |
20 | | 2008. The sustainability plans shall be reviewed and updated |
21 | | periodically, but at least once every 3 years. Units of local |
22 | | government and educational institutions are encouraged to |
23 | | submit similar sustainability plans to the chairman of the |
24 | | Council for review and approval. |
25 | | (b) On or before January 1, 2008, each State agency, using |

1 | | existing resources, shall form an internal environmental |
2 | | sustainability committee. The environmental sustainability |
3 | | committee shall (i) assess the environmental and resource use |
4 | | impacts of its major operational activities making |
5 | | environmental improvements, conserving resources, and reducing |
6 | | health risks; (ii) develop an annual environmental |
7 | | sustainability plan as required under this Act; and (iii) |
8 | | establish an ongoing process through which their |
9 | | sustainability efforts can be reviewed and improved upon. The |
10 | | committee shall focus on the most significant environmental and |
11 | | resource use impacts, examine the feasibility and |
12 | | cost-effectiveness of addressing these impacts, and prioritize |
13 | | their actions accordingly. |
14 | | Where feasible, the committee shall quantify the specific |
15 | | impacts of major operational activities such as gallons of |
16 | | water used, pounds of solid waste generated, gallons of |
17 | | gasoline consumed, and dollars spent per year on electricity. |
18 | | The committee shall consist of representatives from different |
19 | | departments and program areas, including purchasing, |
20 | | maintenance, and facility management. A senior member of |
21 | | management shall be designated to coordinate environmental |
22 | | sustainability efforts of each committee. The coordinator |
23 | | shall provide information to agency facilities and staff, |
24 | | coordinate planning and reporting activities, and act as |
25 | | liaison to the Council. Where appropriate, State agencies may |
26 | | appoint facility coordinators in addition to the agency |

1 | | coordinator. Coordinators shall be given full management |
2 | | support and provided with the necessary resources to meet the |
3 | | goals of this Act. |
4 | | (c) On or before July 1, 2008 and on or before September 1 |
5 | | of each subsequent year, each State agency shall submit to the |
6 | | chairman of the Council a report summarizing the progress made |
7 | | in implementing its annual environmental sustainability plan, |
8 | | including sustainability measures adopted and goals achieved. |
9 | | The information in this report shall encompass the previous |
10 | | fiscal year. |
11 | | On or before June 1, 2008, the Council shall develop and |
12 | | adopt a reporting form to be used to comply with the provisions |
13 | | of this Section. Participating units of local government and |
14 | | educational institutions are encouraged to submit an annual |
15 | | progress report on or before September 1 of each year. |
16 | | (d) State agencies shall be invited to participate in the |
17 | | Council's efforts to foster environmental sustainability |
18 | | practices throughout State government. |
19 | | (e) The Council shall provide technical assistance to State |
20 | | agencies, units of local government, and educational |
21 | | institutions for the purpose of implementing the environmental |
22 | | sustainability planning requirement. |
23 | | (f) The Council may establish criteria for exempting select |
24 | | State agencies from the environmental sustainability planning |
25 | | based on staff size, probable environmental impacts, and scope |
26 | | of operations.

3 | | Sec. 45. Green Governments Illinois website. |
4 | | (a) The Green Governments Illinois staff member of the |
5 | | Lieutenant Governor's Office shall be responsible for |
6 | | establishing and maintaining an Internet website devoted to the |
7 | | Green Governments Illinois program. |
8 | | (b) The content and capabilities of the website shall, at a |
9 | | minimum, include: |
10 | | (1) (blank) the ability to receive submitted plans and |
11 | | reports ; |
12 | | (2) (blank) a downloadable template for preparing |
13 | | reports ; |
14 | | (3) viewable and downloadable plans and reports |
15 | | submitted by the participating units of State and local |
16 | | government and educational institutions; |
17 | | (4) a listing of sources of information on developing |
18 | | environmental programs and Internet links, if available, |
19 | | to those sources; |
20 | | (5) a listing of sources of funding for environmental |
21 | | programs and Internet links, if available, to those |
22 | | sources; |
23 | | (6) information on forming intergovernmental |
24 | | agreements for the purpose of developing collaborative |
25 | | environmental plans between units of local government; and |

1 | | (7) guidance materials to assist State agencies, units |
2 | | of local government, and educational institutions in |
3 | | identifying environmental impacts and evaluating practical |
4 | | actions to prevent pollution and conserve resources.

11 | | becoming law.".
