SYNOPSIS AS INTRODUCED:

    Amends the Board of Higher Education Act. Provides that, following notification to and a period of consultation with the appropriate board of control, the Board of Higher Education is authorized to take action on the dissolution or reduce in scope any and all existing programs of instruction, research, or public service that the Board finds to lack educational or economical justification at the public universities and community colleges. Requires each public university and community college to submit its plan for capital improvements of non-instructional facilities to the Board for approval before final commitments are made only if the total cost of the project as approved by the institution's board of control is in excess of $2 million.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Board of Higher Education Act is amended by
5changing Sections 7 and 8 as follows:

7    Sec. 7. The Board of Trustees of the University of
8Illinois, the Board of Trustees of Southern Illinois
9University, the Board of Trustees of Chicago State University,
10the Board of Trustees of Eastern Illinois University, the Board
11of Trustees of Governors State University, the Board of
12Trustees of Illinois State University, the Board of Trustees of
13Northeastern Illinois University, the Board of Trustees of
14Northern Illinois University, the Board of Trustees of Western
15Illinois University, the Illinois Community College Board and
16the campuses under their governance or supervision shall not
17hereafter undertake the establishment of any new unit of
18instruction, research or public service without the approval of
19the Board. The term "new unit of instruction, research or
20public service" includes the establishment of a college,
21school, division, institute, department or other unit in any
22field of instruction, research or public service not
23theretofore included in the program of the institution, and

1includes the establishment of any new branch or campus. The
2term does not include reasonable and moderate extensions of
3existing curricula, research, or public service programs which
4have a direct relationship to existing programs; and the Board
5may, under its rule making power, define the character of such
6reasonable and moderate extensions.
7    Such governing boards shall submit to the Board all
8proposals for a new unit of instruction, research, or public
9service. The Board may approve or disapprove the proposal in
10whole or in part or approve modifications thereof whenever in
11its judgment such action is consistent with the objectives of
12an existing or proposed master plan of higher education.
13    The Board of Higher Education is authorized to review
14periodically all existing programs of instruction, research
15and public service at the State state universities and colleges
16and to advise the appropriate board of control if the
17contribution of each program is not educationally and
18economically justified. Following notification to and a period
19of consultation with the appropriate board of control, the
20Board of Higher Education is authorized to take action on the
21dissolution or reduce in scope any and all existing programs of
22instruction, research, or public service that the Board finds
23to lack educational or economical justification at the State
24universities and colleges.

2    Sec. 8. The Board of Trustees of the University of
3Illinois, the Board of Trustees of Southern Illinois
4University, the Board of Trustees of Chicago State University,
5the Board of Trustees of Eastern Illinois University, the Board
6of Trustees of Governors State University, the Board of
7Trustees of Illinois State University, the Board of Trustees of
8Northeastern Illinois University, the Board of Trustees of
9Northern Illinois University, the Board of Trustees of Western
10Illinois University, and the Illinois Community College Board
11shall submit to the Board not later than the 15th day of
12November of each year its budget proposals for the operation
13and capital needs of the institutions under its governance or
14supervision for the ensuing fiscal year. Each budget proposal
15shall conform to the procedures developed by the Board in the
16design of an information system for State universities and
17colleges.
18    In order to maintain a cohesive system of higher education,
19the Board and its staff shall communicate on a regular basis
20with all public university presidents. They shall meet at least
21semiannually to achieve economies of scale where possible and
22provide the most innovative and efficient programs and
23services.
24    The Board, in the analysis of formulating the annual budget
25request, shall consider rates of tuition and fees at the state
26universities and colleges. The Board shall also consider the

1current and projected utilization of the total physical plant
2of each campus of a university or college in approving the
3capital budget for any new building or facility.
4    The Board of Higher Education shall submit to the Governor,
5to the General Assembly, and to the appropriate budget agencies
6of the Governor and General Assembly its analysis and
7recommendations on such budget proposals.
8    Each state supported institution within the application of
9this Act must submit its plan for capital improvements of
10non-instructional facilities to the Board for approval before
11final commitments are made if the total cost of the project as
12approved by the institution's board of control is in excess of
13$2 million. Non-instructional uses shall include but not be
14limited to dormitories, union buildings, field houses,
15stadium, other recreational facilities and parking lots. The
16Board shall determine whether or not any project submitted for
17approval is consistent with the master plan for higher
18education and with instructional buildings that are provided
19for therein. If the project is found by a majority of the Board
20not to be consistent, such capital improvement shall not be
21constructed.
