2 | | AMENDMENT NO. ______. Amend House Bill 3186 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 1. Short title. This Act may be cited as the Small |
5 | | Business Contracts Act. |
6 | | Section 5. Definitions. For the purposes of this Act, the |
7 | | following terms shall have the following definitions: |
8 | | "Small business" means a small business as defined in the |
9 | | Illinois Procurement Code. |
10 | | "State contract" means a State contract, as defined in the |
11 | | Illinois Procurement Code, funded with State or federal funds, |
12 | | whether competitively bid or negotiated. |
13 | | "State official or agency" means a department, officer, |
14 | | board, commission, institution, or body politic or corporate of |
15 | | the State. |

1 | | Section 10. Award of State contracts. |
2 | | (a) Not less than 10% of the total dollar amount of State |
3 | | contracts shall be established as a goal to be awarded to small |
4 | | businesses. |
5 | | (b) The percentage in subsection (a) relates to the total |
6 | | dollar amount of State contracts during each State fiscal year, |
7 | | calculated by examining independently each type of contract for |
8 | | each State official or agency which lets such contracts. |
9 | | Section 15. Compliance plans. |
10 | | (a) Each State official or agency shall file with its |
11 | | respective chief procurement officer an annual compliance plan |
12 | | which shall outline the goals of the State official or agency |
13 | | for contracting with small businesses for the then current |
14 | | fiscal year, the manner in which the official or agency intends |
15 | | to reach these goals, and a timetable for reaching these goals. |
16 | | The chief procurement officer shall review and approve the plan |
17 | | of the State official or agency and may reject any plan that |
18 | | does not comply with this Act or any rules promulgated pursuant |
19 | | to this Act. |
20 | | (b) Each State official or agency shall file with its |
21 | | respective chief procurement officer an annual report of its |
22 | | utilization of small businesses during the preceding fiscal |
23 | | year including lapse period spending and a mid-fiscal year |
24 | | report of its utilization to date for the then current fiscal |
25 | | year. The reports shall include a self-evaluation of the |

1 | | efforts of the State official or agency to meet its goals under |
2 | | the Act. |
3 | | Section 20. Annual report. Each chief procurement officer |
4 | | shall file no later than March 1 of each year, an annual report |
5 | | that shall detail the level of achievement toward the goals |
6 | | specified in this Act over the 3 most recent fiscal years. The |
7 | | annual report shall include, but need not be limited to, the |
8 | | following: |
9 | | (1) a summary detailing State appropriations subject |
10 | | to the goals, the actual goals specified, and the goals |
11 | | attained by each State official or agency; |
12 | | (2) a summary of the number of contracts awarded and |
13 | | the average contract amount by each State official or |
14 | | agency; and |
15 | | (3) an analysis of the level of overall goal |
16 | | achievement concerning purchases from small businesses.

17 | | Section 99. Effective date. This Act takes effect upon |
18 | | becoming law.".
