1 | AN ACT concerning State government.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 1. Short title. This Act may be cited as the Small | ||||||
5 | Business Contracts Act. | ||||||
6 | Section 5. Definitions. For the purposes of this Act, the | ||||||
7 | following terms shall have the following definitions: | ||||||
8 | "Small business" means a small business as defined in the | ||||||
9 | Illinois Procurement Code. | ||||||
10 | "State contract" means a State contract, as defined in the | ||||||
11 | Illinois Procurement Code, funded with State or federal funds, | ||||||
12 | whether competitively bid or negotiated. | ||||||
13 | "State official or agency" means a department, officer, | ||||||
14 | board, commission, institution, or body politic or corporate of | ||||||
15 | the State. | ||||||
16 | Section 10. Award of State contracts. | ||||||
17 | (a) Not less than 10% of the total dollar amount of State | ||||||
18 | contracts shall be established as a goal to be awarded to small | ||||||
19 | businesses. | ||||||
20 | (b) The percentage in subsection (a) relates to the total | ||||||
21 | dollar amount of State contracts during each State fiscal year, | ||||||
22 | calculated by examining independently each type of contract for |

1 | each State official or agency which lets such contracts. | ||||||
2 | Section 15. Compliance plans. | ||||||
3 | (a) Each State official or agency shall file with its | ||||||
4 | respective chief procurement officer an annual compliance plan | ||||||
5 | which shall outline the goals of the State official or agency | ||||||
6 | for contracting with small businesses for the then current | ||||||
7 | fiscal year, the manner in which the official or agency intends | ||||||
8 | to reach these goals, and a timetable for reaching these goals. | ||||||
9 | The chief procurement officer shall review and approve the plan | ||||||
10 | of the State official or agency and may reject any plan that | ||||||
11 | does not comply with this Act or any rules promulgated pursuant | ||||||
12 | to this Act. | ||||||
13 | (b) Each State official or agency shall file with its | ||||||
14 | respective chief procurement officer an annual report of its | ||||||
15 | utilization of small businesses during the preceding fiscal | ||||||
16 | year including lapse period spending and a mid-fiscal year | ||||||
17 | report of its utilization to date for the then current fiscal | ||||||
18 | year. The reports shall include a self-evaluation of the | ||||||
19 | efforts of the State official or agency to meet its goals under | ||||||
20 | the Act. | ||||||
21 | Section 20. Annual report. Each chief procurement officer | ||||||
22 | shall file no later than March 1 of each year, an annual report | ||||||
23 | that shall detail the level of achievement toward the goals | ||||||
24 | specified in this Act over the 3 most recent fiscal years. The |

1 | annual report shall include, but need not be limited to, the | ||||||
2 | following: | ||||||
3 | (1) a summary detailing State appropriations subject | ||||||
4 | to the goals, the actual goals specified, and the goals | ||||||
5 | attained by each State official or agency; | ||||||
6 | (2) a summary of the number of contracts awarded and | ||||||
7 | the average contract amount by each State official or | ||||||
8 | agency; and | ||||||
9 | (3) an analysis of the level of overall goal | ||||||
10 | achievement concerning purchases from small businesses.

11 | Section 99. Effective date. This Act takes effect upon | ||||||
12 | becoming law.
