Amends the School Code. Subject to appropriation, authorizes the State Board of Education to provide annual funding to public school districts and State-recognized, non-public schools serving students in grades kindergarten through 12 for the purchase of secular textbooks. Subject to appropriation, provides that each public school district and State-recognized, non-public school shall receive a per pupil grant for the purchase of secular textbooks. Repeals Sections concerning the State Board's loan of secular textbooks; the adoption of books by school boards; the purchase of textbooks from families moving out of a school district; the printing, publishing, distributing and selling of textbooks by a district; the manner and methods of textbook distribution; and rules for the care and preservation of textbooks. Effective July 1, 2011.

3 | | represented in the General Assembly:

4 | | Section 5. The School Code is amended by adding Section |
5 | | 2-3.153 as follows: |

7 | | Sec. 2-3.153. Textbook block grant program. |
8 | | (a) As used in this Section, "textbook" means any book or |
9 | | book substitute that a pupil uses as a text or text substitute, |
10 | | including electronic textbooks. "Textbook" includes books, |
11 | | reusable workbooks, manuals, whether bound or in loose-leaf |
12 | | form, instructional computer software, and electronic |
13 | | textbooks and the technological equipment necessary to gain |
14 | | access to and use electronic textbooks intended as a principal |
15 | | source of study material for a given class or group of |
16 | | students. "Textbook" also includes science curriculum |
17 | | materials in a kit format that includes pre-packaged consumable |
18 | | materials if (i) it is shown that the materials serve as a |
19 | | textbook substitute, (ii) the materials are for use by the |
20 | | pupils as a principal learning source, (iii) each component of |
21 | | the materials is integrally necessary to teach the requirements |
22 | | of the intended course, (iv) the kit includes teacher guidance |
23 | | materials, and (v) the purchase of individual consumable |
