Creates the Synthetic Drug Manipulation Emergency Board Act. Provides that the Governor shall appoint the members of the Synthetic Drug Manipulation Emergency Board. Requires that the Board study state laws that ban synthetic drugs, including, but not limited to, K2. Provides that the Board must prepare and submit a report to the Governor and the General Assembly by January 1, 2012 and each January 1 thereafter, recommending specific synthetic drugs that are likely to endanger the public and the best method for banning those synthetic drugs. Effective immediately.

1 | | AN ACT concerning State government.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 1. Short title. This Act may be cited as the |
5 | | Synthetic Drug Manipulation Emergency Board Act. |
6 | | Section 5. Establishment of the Board; chairperson. |
7 | | (a) The Synthetic Drug Manipulation Emergency Board is |
8 | | established. The Board shall consist of 5 members. The members |
9 | | of the Board shall be appointed by the Governor with the advice |
10 | | and consent of the Senate. Appointees must be retired judges. |
11 | | Of the initial members, 3 shall serve for a 2-year term and 2 |
12 | | shall serve for a 3-year term, as determined by lot. |
13 | | Thereafter, members shall serve for a 4-year term. |
14 | | (b) Members of the Board must be appointed no later than 90 |
15 | | days after the effective date of this Act.

16 | | (c) Vacancies shall be filled in the same manner as |
17 | | appointments. |
18 | | (d) The Board shall elect one member to serve as the |
19 | | chairperson. |
20 | | Section 10. Meetings; quorum. |
21 | | (a) The Board must meet at least quarterly and at the call |
22 | | of the chairperson. |
