1 | | AN ACT concerning State government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The General Assembly Compensation Act is amended |
5 | | by changing Section 1 as follows: |
6 | | (25 ILCS 115/1) (from Ch. 63, par. 14) |
7 | | Sec. 1. Annual salary; mileage. For terms commencing before |
8 | | January 12, 2011, each Each member of the General Assembly |
9 | | shall receive an annual salary
of $28,000 or as set by the |
10 | | Compensation Review Board, whichever is
greater. For terms |
11 | | commencing on or after January 12, 2011, each member of the |
12 | | General Assembly shall receive an annual salary that is no more |
13 | | than 90% of the amount last set by the Compensation Review |
14 | | Board. The
following named officers, committee chairmen and |
15 | | committee minority spokesmen
shall receive additional amounts |
16 | | per year for
their services as such officers, committee |
17 | | chairmen and committee
minority spokesmen respectively, as set |
18 | | by the Compensation
Review Board or, as follows, whichever is |
19 | | greater: Beginning the second
Wednesday in January 1989, the |
20 | | Speaker and the minority leader of the
House of Representatives |
21 | | and the
President and the minority leader of the Senate, |
22 | | $16,000 each; the
majority leader in the House of |
23 | | Representatives $13,500;

Representatives, |
17 | | $6,000 each. A member who serves in more than one
position as |
18 | | an officer, committee chairman, or committee minority |
19 | | spokesman
shall receive only one additional amount based on the |
20 | | position paying the
highest additional amount. The

21 | | compensation provided for in this Section to be paid per year |
22 | | to members
of the General Assembly, including the additional |
23 | | sums payable per year
to officers of the General Assembly shall |
24 | | be paid in 12 equal monthly
installments. The first such |
25 | | installment is payable on January 31,
1977. All subsequent |
26 | | equal monthly installments are payable on the last
working day |

1 | | of the month. A member who has held office any part of a
month |
2 | | is entitled to compensation for an entire month. |
3 | | Mileage shall be paid at the rate of 20 cents per mile |
4 | | before January
9, 1985, and at the mileage allowance rate in |
5 | | effect under regulations
promulgated pursuant to 5 U.S.C. |
6 | | 5707(b)(2) beginning January 9, 1985, for the number
of actual |
7 | | highway miles necessarily and conveniently traveled by the
most |
8 | | feasible route to be present upon convening of the sessions of |
9 | | the
General Assembly by such member in each and every trip |
10 | | during each
session in going to and returning from the seat of |
11 | | government, to be
computed by the Comptroller. A member |
12 | | traveling by public
transportation for such purposes, however, |
13 | | shall be paid his or her actual cost
of that transportation |
14 | | instead of on the mileage rate if his or her cost of
public |
15 | | transportation exceeds the amount to which he or she would be |
16 | | entitled
on a mileage basis. No member may be paid, whether on |
17 | | a mileage basis
or for actual costs of public transportation, |
18 | | for more than one such
trip for each week the General Assembly |
19 | | is actually in session. Each
member shall also receive an |
20 | | allowance of $36 per day for lodging and
meals while in |
21 | | attendance at sessions
of the General Assembly before January |
22 | | 9, 1985; beginning January 9,
1985, such food and lodging |
23 | | allowance shall be equal to the amount per day
permitted to be |
24 | | deducted for such expenses under the Internal Revenue Code;

25 | | however, beginning May 31, 1995, no allowance for food and |
26 | | lodging while in
attendance at sessions is authorized for |
|

1 | | periods of time after the last day in
May of each calendar |
2 | | year, except (i) if the General Assembly is convened in
special |
3 | | session by either the Governor or the presiding officers of |
4 | | both
houses, as provided by subsection (b) of Section 5 of |
5 | | Article IV of the
Illinois Constitution or (ii) if the
General |
6 | | Assembly is convened to consider bills vetoed, item vetoed, |
7 | | reduced, or
returned with specific recommendations for change |
8 | | by the Governor as provided
in Section 9 of Article IV of the |
9 | | Illinois Constitution. Notwithstanding any other provision, |
10 | | for fiscal year 2011 only (i) the allowance for lodging and |
11 | | meals is $111 per day and (ii) mileage for automobile travel |
12 | | shall be reimbursed at a rate of $0.39 per mile. |
13 | | If a member dies having received only a portion of the |
14 | | amount payable
as compensation, the unpaid balance shall be |
15 | | paid to the surviving
spouse of such member, or, if there be |
16 | | none, to the estate of such member. |

18 | | Section 10. The Compensation Review Act is amended by |
19 | | changing Section 5.7 and adding Section 5.8 as follows: |
20 | | (25 ILCS 120/5.7) |
21 | | Sec. 5.7. FY11 COLA's prohibited. Notwithstanding any |
22 | | former or current provision of this Act, any other law, any |
23 | | report of the Compensation Review Board, or any resolution of |
24 | | the General Assembly to the contrary, members of the General |

1 | | Assembly, State's attorneys, other than the county supplement, |
2 | | elected executive branch constitutional officers of State |
3 | | government, and persons in certain appointed offices of State |
4 | | government, including the membership of State departments, |
5 | | agencies, boards, and commissions, whose annual compensation |
6 | | previously was recommended or determined by the Compensation |
7 | | Review Board, are prohibited from receiving and shall not |
8 | | receive any increase in compensation that would otherwise apply |
9 | | based on a cost of living adjustment, as authorized by Senate |
10 | | Joint Resolution 192 of the 86th General Assembly, for or |
11 | | during the fiscal year beginning July 1, 2010. That cost of |
12 | | living adjustment shall apply again in the fiscal year |
13 | | beginning July 1, 2011 and thereafter , except as provided in |
14 | | Section 5.8 .
