2 | | AMENDMENT NO. ______. Amend House Bill 2889 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The School Code is amended by adding Sections |
5 | | 10-20.53 and 34-18.45 as follows: |
6 | | (105 ILCS 5/10-20.53 new) |
7 | | Sec. 10-20.53. Internet use policy. |
8 | | (a) No State funds made available under this Code to a |
9 | | school district may be used to purchase computers used to |
10 | | access the Internet or to pay for direct costs associated with |
11 | | accessing the Internet, unless the school board has in place a |
12 | | policy of Internet safety for minors that includes the |
13 | | operation of a technology protection measure, with respect to |
14 | | any of the district's computers with Internet access, that |
15 | | protects against access through those computers to visual |
16 | | depictions that are (i) obscene, (ii) child pornography, or |

1 | | (iii) harmful to minors. The policy must enforce the operation |
2 | | of the technology protection measures during any use of the |
3 | | computers by minors. Beginning with the 2011-2012 school year, |
4 | | each school board must make available a copy of the policy at |
5 | | its office and must post the policy on the district's Internet |
6 | | website, if any. |
7 | | (b) An administrator, supervisor, or person authorized by |
8 | | the responsible authority may temporarily disable the |
9 | | technology protection measure to enable access for bona fide |
10 | | research or other lawful purposes. Once the research session is |
11 | | complete, the technology protection measure must be |
12 | | reactivated. |
13 | | (c) If a school district stops receiving federal technology |
14 | | funds that require the use of a technology protection measure, |
15 | | then the school board must certify its Internet safety policy |
16 | | to the State Board of Education. |
17 | | (d) This Section does not apply to schools created under |
18 | | the Illinois Mathematics and Science Academy Law and laboratory |
19 | | schools, as defined in Section 18-8.05 of this Code. |
