1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Higher Education Student Assistance Act is
5amended by changing Section 36 as follows:
 
6    (110 ILCS 947/36)
7    Sec. 36. Silas Purnell Illinois Incentive for Access grant
8program.
9    (a) The The Commission each year shall determine
10eligibility for the Illinois Incentive for Access grant from
11applications received for Monetary Award Program grant
12assistance under Section 35 of this Act. An applicant shall be
13determined as eligible for an Illinois Incentive for Access
14grant under this Section when the Commission finds that the
15applicant:
16        (1) is a resident of this State and a citizen or
17    permanent resident of the United States;
18        (2) has limited personal or family financial resources
19    available for expenditure on educational expenses, as
20    defined by current federal student financial aid
21    methodology;
22        (3) has not already received a baccalaureate degree;
23    and

1        (4) is enrolled at least one-half time as a freshman
2    undergraduate student at an approved Illinois institution
3    of higher learning participating in the Monetary Award
4    Program administered by the Commission.
5    (b) Subject to a separate appropriation made for purposes
6of awarding grants under this Section, Illinois Incentive for
7Access grants shall be paid in multiple disbursements as
8determined by the Commission (i) in an amount not to exceed
9$1,000 per applicant per year for applicants with an expected
10family contribution of $0, as defined by current federal
11student aid methodology, and (ii) in an amount not to exceed
12$500 for applicants with an expected family contribution of
13$500 or less but more than $0, as defined by current federal
14student aid methodology. In awarding grants, the Commission
15shall give priority to applicants with an expected family
16contribution of $0. No recipient may receive a grant under this
17Section for more than 2 semesters or 3 quarters of award
18payments.
19    (c) Eligibility for grants awarded under this Section shall
20be determined solely on the basis of the financial resources of
21the applicant and the applicant's family. Cost of attendance at
22the institution in which the applicant is enrolled shall not
23affect eligibility for an award, except that State student
24financial assistance awarded under this Act, including the
25Illinois Incentive for Access award, may not exceed the
26institution's cost of attendance.

1    (d) The Commission shall notify applicants that grant
2assistance is contingent upon availability of appropriated
3funds.
4    (e) The Commission shall submit a written evaluation of the
5Illinois Incentive for Access program to the Governor, the
6General Assembly, and the Board of Higher Education on or
7before October 1, 1999, including a report of the progress made
8toward the goal of increasing the access and retention rates
9for Illinois Incentive for Access grant recipients.
