2 | | AMENDMENT NO. ______. Amend House Bill 2568 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Park District Aquarium and Museum Act is |
5 | | amended by changing Section 1 as follows:
|
6 | | (70 ILCS 1290/1) (from Ch. 105, par. 326)
|
7 | | Sec. 1. The corporate authorities of cities and park |
8 | | districts having the
control or supervision of any public park |
9 | | or parks, are hereby authorized
to purchase, erect and maintain |
10 | | within any public park or parks under the
control or |
11 | | supervision of such corporate authorities, edifices to be used
|
12 | | as aquariums or as museums of art, industry, science or natural |
13 | | or other
history, or to permit the directors or trustees of any |
14 | | corporation or
society organized for the construction or |
15 | | maintenance and operation of an
aquarium or museum as |
16 | | hereinabove described to erect, enlarge, ornament,
build, |

1 | | rebuild, rehabilitate, improve, maintain and operate its |
2 | | aquarium or
museum or museums within any public park now or |
3 | | hereafter under the control
or supervision of any city or park |
4 | | district, and to contract with any such
directors or trustees |
5 | | of any such aquarium, museum or museums relative to
the |
6 | | erection, enlargement, ornamentation, building, rebuilding,
|
7 | | rehabilitation, improvement, maintenance and operation |
8 | | thereof. Any city or
park district may charge, or permit such |
9 | | an aquarium or museum to charge,
an admission fee. Any such |
10 | | aquarium or museum,
however, shall be open without charge, when
|
11 | | accompanied by a teacher, to the children in actual attendance |
12 | | upon grades
kindergarten through twelve in any of the schools |
13 | | in this State at all
times. Any such aquarium or museum, |
14 | | however, must be open to the
public without
charge
for a period |
15 | | equivalent to 26 52 days, at least 6 of which must be during |
16 | | the
period from June through August, each year.
Notwithstanding |
17 | | said provisions, charges may be made at any
time for
special |
18 | | services and for admission to special facilities within any
|
19 | | aquarium or museum for the education, entertainment or |
20 | | convenience of
visitors. The proceeds of such admission fees |
21 | | and charges for special
services and special facilities shall |
22 | | be devoted exclusively to the
purposes for which the tax |
23 | | authorized by Section 2 hereof may be used. If
any owner or |
24 | | owners of any lands or lots abutting or fronting on any such
|
25 | | public park, or adjacent thereto, have any private right, |
26 | | easement,
interest or property in such public park appurtenant |

1 | | to their lands or lots
or otherwise, which would be interfered |
2 | | with by the erection and
maintenance of any aquarium or museum |
3 | | as hereinbefore provided, or any
right to have such public park |
4 | | remain open or vacant and free from
buildings, the corporate |
5 | | authorities of the city or park district having
control of such |
6 | | park, may condemn the same in the manner prescribed for the
|
7 | | exercise
of the right of eminent domain under the Eminent |
8 | | Domain Act.
