2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | changing Section 5-2.1a as follows:
|

7 | | Sec. 5-2.1a. Treatment of trust amounts. To the
the extent |
8 | | required by
federal
law, the Illinois Department shall provide |
9 | | by rule for the consideration of
trusts and similar legal |
10 | | instruments or devices established by a person in the
Illinois |
11 | | Department's determination of the person's eligibility for and |
12 | | the
amount of assistance provided under this Article.
This |
13 | | Section shall be enforced by the Department of Human Services, |
14 | | acting as
successor to the Department of Public Aid under the |
15 | | Department of Human
Services Act. |
