50 ILCS 748/5

    Amends the Volunteer Emergency Worker Job Protection Act. Provides that no public or private employer may take disciplinary action against an employee who is a volunteer emergency worker because the employee, when acting as a volunteer worker, is absent from or late to his or her employment in order to respond to an emergency. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Volunteer Emergency Worker Job Protection
5Act is amended by changing Section 5 as follows:
 
6    (50 ILCS 748/5)
7    Sec. 5. Volunteer emergency worker; when termination of
8employment prohibited.
9    (a) No public or private employer may terminate or take
10disciplinary action against an employee who is a volunteer
11emergency worker because the employee, when acting as a
12volunteer emergency worker, is absent from or late to his or
13her employment in order to respond to an emergency prior to the
14time the employee is to report to his or her place of
15employment.
16    (b) An employer may charge, against the employee's regular
17pay, any time that an employee who is a volunteer emergency
18worker loses from employment because of the employee's response
19to an emergency in the course of performing his or her duties
20as a volunteer emergency worker.
21    (c) In the case of an employee who is a volunteer emergency
22worker and who loses time from his or her employment in order
23to respond to an emergency in the course of performing his or

1her duties as a volunteer emergency worker, the employer has
2the right to request the employee to provide the employer with
3a written statement from the supervisor or acting supervisor of
4the volunteer fire department or governmental entity that the
5volunteer emergency worker serves stating that the employee
6responded to an emergency and stating the time and date of the
7emergency.
8    (d) An employee who is a volunteer emergency worker and who
9may be absent from or late to his or her employment in order to
10respond to an emergency in the course of performing his or her
11duties as a volunteer emergency worker must make a reasonable
12effort to notify his or her employer that he or she may be
13absent or late.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.
