2 | | AMENDMENT NO. ______. Amend House Bill 2095 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Service Member's Employment Tenure Act is |
5 | | amended by changing Section 6 and by adding Section 8 as |
6 | | follows:
|
7 | | (330 ILCS 60/6) (from Ch. 126 1/2, par. 34)
|
8 | | Sec. 6. Employer's violation of Act; penalty; employee's |
9 | | remedies.
|
10 | | (a) An employer's knowing violation of this Act is a |
11 | | business offense punishable by a fine of not less than $5,000 |
12 | | and not more than $10,000.
|
13 | | (b) In addition to any other penalty provided by law, an |
14 | | employer's knowing violation of this Act constitutes a civil |
15 | | rights violation under the Illinois Human Rights Act. In case |
16 | | any employer fails or refuses to comply with
this Act, the |

1 | | circuit court of the county in which such private employer
|
2 | | maintains a place of business, or of the county where such |
3 | | State employee
performs most of his duties, has power, upon the |
4 | | filing of a complaint
by the person entitled to
the benefits of |
5 | | this Act, to specifically require such employer to comply
with |
6 | | this Act and to compensate such person for any loss of wages or
|
7 | | benefits suffered by reason of such employer's unlawful action, |
8 | | together
with reasonable attorney's fees and costs. No fees or |
9 | | court costs shall be taxed
against any person applying for the |
10 | | benefits of this Act.
|
11 | | The court shall, in its sound discretion, give preference |
12 | | to the hearing
and disposition of such cases over other matters |
13 | | then pending before it.

16 | | Sec. 8. Attorney General; employer list. The Attorney |
17 | | General shall establish and maintain a statewide list of |
18 | | employers who have been convicted of violating this Act. The |
19 | | Attorney General shall make the information in the list |
20 | | available to the public on its official web site and by any |
21 | | other means the Attorney General deems appropriate.

22 | | Section 99. Effective date. This Act takes effect upon |
23 | | becoming law.".
