AMENDMENT TO HOUSE BILL 2088 




2    AMENDMENT NO. ______. Amend House Bill 2088 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 5. The Illinois Pension Code is amended  by 
5changing Section 2-105 as follows:
 



6    (40 ILCS 5/2-105)  (from Ch. 108 1/2, par. 2-105)



7    Sec. 2-105. Member. "Member": Members of the General 
8Assembly of this
State including persons who enter military 
9service while a member of the
General Assembly and any person 
10serving as Governor,
Lieutenant Governor, Secretary of State, 
11Treasurer, Comptroller, or Attorney
General for the period of 
12service in such office, unless the person has elected in 
13accordance with this Article not to participate in the system.

14    Until the effective date of this amendatory Act of the 97th 
15General Assembly, any Any person who has served for 10 or more 
16years as Clerk or Assistant Clerk
of the House of

1Representatives, Secretary or Assistant Secretary of the

2Senate, or any combination thereof, may elect to become a 
3member
of this system while thenceforth engaged in such service 
4by filing a
written election with the board.  Any person so 
5electing shall be
deemed an active member of the General 
6Assembly for the purpose of validating
and transferring any 
7service credits earned under any of the funds and systems

8established under Articles 3 through 18 of this Code.

9    A person who, on or after the effective date of this 
10amendatory Act of the 97th General Assembly,  first becomes a 
11member of the system may irrevocably elect whether to 
12participate in the system.

14    Section 99. Effective date. This Act takes effect upon 
15becoming law.".
