1 | | coterminous municipality shall assume the duties of Township |
2 | | Collector under this Code. |
3 | | Section 10. The Township Code is amended by changing |
4 | | Section 50-20 and by adding Section 25-30 as follows: |
5 | | (60 ILCS 1/25-30 new) |
6 | | Sec. 25-30. Discontinuance of a coterminous township. |
7 | | (a) Notwithstanding any provision of Section 25-10 to the |
8 | | contrary, the board of trustees of a coterminous township may, |
9 | | by ordinance, submit a proposition to discontinue township |
10 | | organization to the electors of the township at a general |
11 | | election or consolidated election in accordance with general |
12 | | election law. The proposition must be approved by the corporate |
13 | | authorities of the coterminous municipality prior to placement |
14 | | on a ballot. |
15 | | The proposition shall be in substantially the following |
16 | | form: |
17 | | Shall the township organization be continued in (name |
18 | | of township)? |
19 | | The votes shall be recorded as "Yes" or "No". |
20 | | If it appears by the returns of the election that a |
21 | | three-fifths majority of the votes of the township cast on the |
22 | | question of the continuance of township organization at the |
23 | | election are against the proposed option for continuance, then |
24 | | township organization shall cease in the township on January 1 |

1 | | of the calendar year immediately following the calendar year |
2 | | that the proposition was approved by the electors. Upon |
3 | | discontinuance of township organization, all powers, duties, |
4 | | assets, property, liabilities, obligations, and |
5 | | responsibilities of the township shall be assumed by the |
6 | | coterminous municipality. |
7 | | (b) If it appears by the returns of the election that a |
8 | | three-fifths majority of the votes of the township cast on the |
9 | | question of the continuance of township organization are |
10 | | against continuance, then all elected township offices shall |
11 | | cease in the township at the next January 1 after the |
12 | | proposition was approved. If township organization ceases, |
13 | | then the coterminous municipality shall assume the duties of |
14 | | all elected township offices. |
15 | | (c) The coterminous municipality shall not assume taxing |
16 | | authority of the township abolished under this Section. In the |
17 | | event that a coterminous township is discontinued under this |
18 | | Section, all township revenues as of the next January 1 after |
19 | | the proposition was approved shall be transferred to the |
20 | | coterminous municipality. |
21 | | (d) Upon discontinuance of township organization, the |
22 | | records of the township shall be deposited in the city or |
23 | | village clerk's office, as applicable. The coterminous |
24 | | municipality may close up all unfinished business of the |
25 | | township and sell and dispose of any of the property belonging |
26 | | to the township, as fully as might have been done by the |

1 | | township itself, for benefit of the inhabitants of the |
2 | | municipality. |
3 | | (e) Nothing in this Section shall prevent the coterminous |
4 | | municipality from entering into an intergovernmental agreement |
5 | | or contract to provide for general assistance or property |
6 | | assessment duties for services under its jurisdiction.

8 | | Sec. 50-20. Counties with no township collector. No |
9 | | collector in counties under 100,000. |
10 | | (a) No collector in counties under 100,000. In counties |
11 | | under
township organization, having a population of less than |
12 | | 100,000, there shall be
no township collector elected. The |
13 | | county collector shall be ex-officio
township collector, and |
14 | | all the duties of the township collector shall devolve
upon and |
15 | | be performed by the county collector.

16 | | (b) No collector in counties over 2,000,000. In counties |
17 | | having a population of more than 2,000,000 inhabitants there |
18 | | shall be no township collector elected on and after the |
19 | | effective date of this amendatory Act of the 97th General |
20 | | Assembly. Upon the completion of the terms of office of |
21 | | township collectors holding office on the effective date of |
22 | | this amendatory Act of the 97th General Assembly, the township |
23 | | assessor shall be the ex-officio township collector, and all |
24 | | the duties of the township collector shall devolve upon and be |
25 | | performed by the township assessor. |

2 | | Section 15. The Public Health District Act is amended by |
3 | | adding Section 25 as follows: |
4 | | (70 ILCS 905/25 new) |
5 | | Sec. 25. Cessation of Township Assessor. If the office of |
6 | | Township Assessor in a coterminous township ceases as provided |
7 | | in Section 25-30 of the Township Code, then the city council or |
8 | | village board members of the coterminous municipality shall be |
9 | | the board of health for the public health district under this |
10 | | Act. |
11 | | Section 20. The Illinois Public Aid Code is amended by |
12 | | adding Section 12-3.1 as follows: |

14 | | Sec. 12-3.1. Discontinuance of a coterminous township. |
15 | | Upon discontinuance of a coterminous township as provided in |
16 | | Section 25-30 of the Township Code, the coterminous |
17 | | municipality shall provide funds for and administer the public |
18 | | aid program provided for under Article VI of this Code. |
19 | | Section 25. The Illinois Highway Code is amended by adding |
20 | | Section 5-210 as follows: |
