1 | | Sec. 25-30. Discontinuance of a coterminous township. |
2 | | (a) Notwithstanding any provision of Section 25-10 to the |
3 | | contrary, the board of trustees of a coterminous township may, |
4 | | by ordinance, submit a proposition to discontinue township |
5 | | organization to the electors of the township at a general |
6 | | election or consolidated election in accordance with general |
7 | | election law. The proposition must be approved by the corporate |
8 | | authorities of the coterminous municipality prior to placement |
9 | | on a ballot. |
10 | | The proposition shall be in substantially the following |
11 | | form: |
12 | | Shall the township organization be continued in (name |
13 | | of township)? |
14 | | The votes shall be recorded as "Yes" or "No". |
15 | | If it appears by the returns of the election that a |
16 | | three-fifths majority of the votes of the township cast on the |
17 | | question of the continuance of township organization at the |
18 | | election are against the proposed option for continuance, then |
19 | | township organization shall cease in the township on January 1 |
20 | | of the calendar year immediately following the calendar year |
21 | | that the proposition was approved by the electors. Upon |
22 | | discontinuance of township organization, all powers, duties, |
23 | | assets, property, liabilities, obligations, and |
24 | | responsibilities of the township shall be assumed by the |
25 | | coterminous municipality. |
26 | | (b) If it appears by the returns of the election that a |

1 | | majority of the votes of the township cast on the question of |
2 | | the continuance of township organization are against |
3 | | continuance, then the office of Township Supervisor and the |
4 | | office of Township Assessor shall cease in the township at the |
5 | | next January 1 after the proposition was approved. If the |
6 | | office of Township Supervisor ceases, then the coterminous |
7 | | municipality shall assume the duties of Township Supervisor. If |
8 | | the office of Township Assessor ceases, then the coterminous |
9 | | municipality shall assume the duties of the Township Assessor |
10 | | under the Property Tax Code and the Public Health District Act. |
11 | | (c) The coterminous municipality shall assume all taxing |
12 | | authority of the township abolished under this Section. For |
13 | | purposes of distribution of revenue, the coterminous |
14 | | municipality shall assume the powers, duties, and obligations |
15 | | of the township. |
16 | | (d) Upon discontinuance of township organization, the |
17 | | records of the township shall be deposited in the city clerk's |
18 | | office. The coterminous municipality may close up all |
19 | | unfinished business of the township and sell and dispose of any |
20 | | of the property belonging to the township, as fully as might |
21 | | have been done by the township itself, for benefit of the |
22 | | inhabitants of the municipality. |
23 | | (e) Nothing in this Section shall prevent the coterminous |
24 | | municipality from entering into an intergovernmental agreement |
25 | | or contract to provide for general assistance or property |
26 | | assessment duties for services under its jurisdiction.

2 | | Sec. 50-20. Counties with no township collector. No |
3 | | collector in counties under 100,000. |
4 | | (a) No collector in counties under 100,000. In counties |
5 | | under
township organization, having a population of less than |
6 | | 100,000, there shall be
no township collector elected. The |
7 | | county collector shall be ex-officio
township collector, and |
8 | | all the duties of the township collector shall devolve
upon and |
9 | | be performed by the county collector.

10 | | (b) No collector in counties over 2,000,000. In counties |
11 | | having a population of more than 2,000,000 inhabitants there |
12 | | shall be no township collector elected on and after the |
13 | | effective date of this amendatory Act of the 97th General |
14 | | Assembly. Upon the completion of the terms of office of |
15 | | township collectors holding office on the effective date of |
16 | | this amendatory Act of the 97th General Assembly, the township |
17 | | assessor shall be the ex-officio township collector, and all |
18 | | the duties of the township collector shall devolve upon and be |
19 | | performed by the township assessor. |

21 | | Section 15. The Public Health District Act is amended by |
22 | | adding Section 25 as follows: |

1 | | Sec. 25. Cessation of Township Assessor. If the office of |
2 | | Township Assessor in a coterminous township ceases as provided |
3 | | in Section 25-30 of the Township Code, then the city council |
4 | | members of the coterminous municipality shall be the board of |
5 | | health for the public health district under this Act. |
6 | | Section 20. The Illinois Public Aid Code is amended by |
7 | | adding Section 12-3.1 as follows: |

9 | | Sec. 12-3.1. Discontinuance of a coterminous township. |
10 | | Upon discontinuance of a coterminous township, the coterminous |
11 | | municipality shall provide funds for and administer the public |
12 | | aid program provided for under Article VI of this Code.

13 | | Section 99. Effective date. This Act takes effect upon |
14 | | becoming law.".
