SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-6-1.2 new

    Amends the Illinois Municipal Code. Provides that the corporate authorities of a municipality may fix, charge, and collect fees not exceeding the reasonable cost of the service for all emergency services rendered by the municipality against persons, businesses, and other entities who are not residents of the municipality. Specifies that the fee shall be computed at a rate not to exceed $250 per hour for emergency assistance. Provides that no fee shall be imposed for fire and rescue services when the total cost is less than $50. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 11-6-1.2 as follows:
 
6    (65 ILCS 5/11-6-1.2 new)
7    Sec. 11-6-1.2. Fee for emergency fire and rescue services.
8    (a) The corporate authorities of a municipality may fix,
9charge, and collect fees not exceeding the reasonable cost of
10the service for all emergency fire and rescue services rendered
11by the municipality against persons, businesses, and other
12entities who are not residents of the municipality.
13    (b) The fee may not be assessed against residents of the
14municipality or persons who request fire protection coverage
15for an unprotected area and pay to the municipality an amount
16equal to the municipality's fire protection tax levied pursuant
17to Section 11-7-1.
18    (c) The fee shall be computed at a rate not to exceed $250
19per hour for emergency assistance. An additional charge may be
20levied to reimburse the municipality for extraordinary
21expenses of materials used in rendering such emergency fire and
22rescue services. No fee shall be imposed for fire and rescue
23services for which the total cost is less than $50.

1    (d) All revenue from the fees assessed pursuant to this
2Section shall be deposited into the general fund of the
3municipality.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.
