SYNOPSIS AS INTRODUCED:
 
70 ILCS 2605/4.8  from Ch. 42, par. 323.8
70 ILCS 2605/11.7  from Ch. 42, par. 331.7

    Amends the Metropolitan Water Reclamation District Act. Adds that notice of an examination for a position with the sanitary district may be given by the director of the sanitary district by posting the information for at least 2 weeks before the examination on the sanitary district's official website. Provides that proposals to award purchase orders or contracts involving amounts in excess of the mandatory competitive bid threshold may be posted on the sanitary district's official website. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Metropolitan Water Reclamation District Act
5is amended by changing Sections 4.8 and 11.7 as follows:
 
6    (70 ILCS 2605/4.8)  (from Ch. 42, par. 323.8)
7    Sec. 4.8. Notice of examination. Notice of the time and
8place and general scope and fee of every examination and of the
9duties, pay, and nature of the position sought to be filled
10shall be given by the Director by (i) publication for 2 weeks
11preceding such examination, in a daily newspaper of general
12circulation published in the county in which the said sanitary
13district is situated or (ii) posting for at least 2 weeks
14before the examination on the sanitary district's official
15website. Notice and such notice shall also be posted by the
16Director him in a conspicuous place in his or her office for 2
17weeks before the such examinations.

20    Sec. 11.7. Publication of proposals to award contracts. All
21proposals to award purchase orders or contracts involving
22amounts in excess of the mandatory competitive bid threshold

1shall be published at least 12 calendar days in advance of the
2date announced for the receiving of bids, in a secular English
3language newspaper of general circulation in the said sanitary
4district or posted on the sanitary district's official website.
5The proposals and shall also be posted simultaneously on
6readily accessible bulletin boards in the principal office of
7the sanitary district. Nothing contained in this Section
8section shall be construed to prohibit the placing of
9additional advertisements in recognized trade journals.
10Advertisements for bids shall describe the character of the
11proposed contract or agreement in sufficient detail either in
12the advertisement itself or by reference to plans,
13specifications, or other details detail on file at the time of
14publication or posting of the first announcement, to enable the
15bidders to know what their obligation will be. The
16advertisement shall also state the date, time, and place
17assigned for the opening of bids. No bids shall be received at
18any time subsequent to the time indicated in the announcement;
19however, an extension of time may be granted for the opening of
20the such bids upon publication in the same newspaper of general
21circulation in the said sanitary district or posting on the
22sanitary district's official website stating the date to which
23the bid opening has been extended. The time of the extended bid
24opening shall not be less than 5 days after publication or
25posting, Sundays and legal holidays excluded.
26    Cash, cashier's check, or a certified check payable to the

1clerk and drawn upon a bank, as a deposit of good faith, in a
2reasonable amount not in excess of 10% of the contract amount,
3may be required of each bidder by the director of procurement
4and materials management on all bids involving amounts in
5excess of the mandatory competitive bid threshold. If a deposit
6is required, the advertisement for bids shall so specify.
7Instead of a deposit, the director of procurement and materials
8management may allow the use of a bid bond if the bond is
9issued by a surety company that is listed in the Federal
10Register and is authorized to do business in the State of
11Illinois.

13    Section 99. Effective date. This Act takes effect upon
14becoming law.
