Amends the Metropolitan Water Reclamation District Act. Adds that notice of an examination for a position with the sanitary district may be given by the director of the sanitary district by posting the information for at least 2 weeks before the examination on the sanitary district's official website. Provides that proposals to award purchase orders or contracts
involving amounts in excess of the mandatory competitive bid threshold may be posted on the sanitary district's official website. Effective immediately.

|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Metropolitan Water Reclamation District Act |
5 | | is amended by changing Sections 4.8 and 11.7 as follows:
|
6 | | (70 ILCS 2605/4.8) (from Ch. 42, par. 323.8)

7 | | Sec. 4.8. Notice of examination. Notice of the time and |
8 | | place and general scope and fee of every
examination and of the |
9 | | duties, pay , and nature of the position sought to be
filled |
10 | | shall be given by the Director by (i) publication for 2 weeks |
11 | | preceding
such examination, in a daily newspaper of general |
12 | | circulation published in
the county in which the said sanitary |
13 | | district is situated or (ii) posting for at least 2 weeks |
14 | | before the examination on the sanitary district's official |
15 | | website. Notice and such notice
shall also be posted by the |
16 | | Director him in a conspicuous place in his or her office for 2 |
17 | | weeks
before the such examinations.

20 | | Sec. 11.7. Publication of proposals to award contracts. All |
21 | | proposals to award purchase orders or contracts
involving |
22 | | amounts in excess of the mandatory competitive bid threshold |

published
at least 12 calendar days in advance of the |
2 | | date announced for the receiving of
bids, in a secular English |
3 | | language newspaper of general circulation in
the said sanitary |
4 | | district or posted on the sanitary district's official website. |
5 | | The proposals and shall also be posted simultaneously on |
6 | | readily
accessible bulletin boards in the principal office of |
7 | | the sanitary
district. Nothing contained in this Section |
8 | | section shall be construed to
prohibit the placing of |
9 | | additional advertisements in recognized trade
journals. |
10 | | Advertisements for bids shall describe the character of the
|
11 | | proposed contract or agreement in sufficient detail either in |
12 | | the
advertisement itself or by reference to plans, |
13 | | specifications , or other
details detail on file at the time of |
14 | | publication or posting of the first announcement, to
enable the |
15 | | bidders to know what their obligation will be. The
|
16 | | advertisement shall also state the date, time , and place |
17 | | assigned for the
opening of bids. No bids shall be received at |
18 | | any time subsequent to the
time indicated in the announcement; |
19 | | however, an extension of time may be
granted for the opening of |
20 | | the such bids upon publication in the same
newspaper of general |
21 | | circulation in the said sanitary district or posting on the |
22 | | sanitary district's official website stating the
date to which |
23 | | the bid opening has been extended. The time of the extended
bid |
24 | | opening shall not be less than 5 days after publication or |
25 | | posting , Sundays and
legal holidays excluded.

26 | | Cash, cashier's check , or a certified check payable to the |

1 | | clerk and
drawn upon a bank, as a deposit of good faith, in a |
2 | | reasonable amount
not in excess of 10% of the contract amount, |
3 | | may be required of each
bidder by the director of procurement |
4 | | and materials management on all bids involving amounts in |
5 | | excess
of the mandatory competitive bid threshold. If a deposit |
6 | | is
required, the advertisement for
bids shall so specify. |
7 | | Instead of a deposit, the director of procurement and materials |
8 | | management may allow
the use of a bid bond if the bond is |
9 | | issued by a surety company that is listed
in the Federal |
10 | | Register and is authorized to do business in the State of
|
11 | | Illinois.
