1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Criminal Justice Information Act is
5amended by adding Section 7.8 as follows:
 
6    (20 ILCS 3930/7.8 new)
7    Sec. 7.8. Surveillance cameras.
8    (a) By July 1, 2012, the Authority must (i) create a form
9for agencies to list the number of cameras that they own or
10have access to and (ii) post that form on the Authority's
11official Internet website.
12    (b) By December 31, 2012 and each December 1 thereafter,
13each agency that owns or has access to a camera shall provide
14to the Authority the following: (i) the completed form
15described in subsection (a) and (ii) a copy of any policies
16adopted by the agency that address camera use including: (A)
17policies that protect the privacy or civil liberties and rights
18of the general public, (B) minimal retention policies, (C)
19editing policies, (D) policies that address the sharing of data
20with other public and private entities, and (E) policies that
21restrict public access to data based upon a potential security
22compromise.
23    (c) By July 1, 2013 and each July 1 thereafter, the

1following information must be posted on the Authority's
2official Internet website for the prior calendar year: (i) all
3documents provided by an agency under subsection (b) and (ii) a
4list of agencies that own or have access to cameras and the
5number of cameras that each agency owns or has access to.
6    (d) This Section does not require an agency to disclose the
7location of any camera.
8    (e) For the purposes of this Section, "access" means
9real-time access to images from a camera.
10    For the purposes of this Section, "agency" means the
11following: (i) State agencies including all officers, boards,
12commissions, agencies, departments, committees, and
13authorities created by the Constitution, whether in the
14executive or legislative branch; (ii) municipalities and any
15other unit of local government; (iii) public institutions of
16higher learning as defined in Section 2 of the Higher Education
17Cooperation Act; (iv) school districts and public schools of
18this State including special charter districts, Department of
19Juvenile Justice School Districts, laboratory schools operated
20by the governing board of a public university, and alternative
21schools operated by a regional superintendent of schools; (v)
22boards of election commissioners; (vi) bodies politic and
23corporate of the State; (vii) administrative units or corporate
24outgrowths of State government created by or pursuant to
25statute; and (viii) all administrative units and corporate
26outgrowths of the entities described in this definition and as

1may be created by executive order of the Governor.
2    For the purposes of this Section, "camera" means any video
3surveillance camera that is located outdoors or within a public
4transit system. The term does not include a camera used
5principally to enforce traffic laws or to provide vehicle
6detection for traffic control devices or systems.
