| 1 | | AN ACT concerning government.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The State Officials and Employees Ethics Act is |
| 5 | | amended by adding Section 5-57 as follows:
|
| 6 | | (5 ILCS 430/5-57 new) |
| 7 | | Sec. 5-57. Divesting or freezing of election funds of board |
| 8 | | and commission members. Any appointed member of a board or |
| 9 | | commission whose appointment required the advice and consent of |
| 10 | | the Senate and who receives a salary from the State must either |
| 11 | | (1) divest himself or herself of any funds supporting his or |
| 12 | | her candidacy for any federal, State, or local public office by |
| 13 | | (A) a direct return of funds to contributors in amounts not to |
| 14 | | exceed his or her individual contributions, (B) a transfer of |
| 15 | | funds to a charitable organization or organizations, or (C) a |
| 16 | | combination of items (A) and (B), or (2) have the funds placed |
| 17 | | in an account that is frozen for the duration of his or her |
| 18 | | term as a member of the board or commission, except for account |
| 19 | | activity related to covering the reasonable costs of |
| 20 | | maintaining the account. Failure to comply with this Section |
| 21 | | shall render the office vacant.

| 22 | | Section 99. Effective date. This Act takes effect upon |
