Amends the Illinois Municipal Code. Provides that whenever an unincorporated parcel of land that is within the boundaries of a fire protection district is annexed into the corporate limits of a municipality with a municipal fire department, the municipal fire department and the fire protection district may negotiate an intergovernmental agreement to allow the fire protection district to have jurisdiction over the annexed parcel. If no agreement is adopted, then the automatic transfer of jurisdiction from the fire protection district to the municipality shall occur upon annexation. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Municipal Code is amended by adding |
5 | | Section 11-6-7 as follows: |

7 | | Sec. 11-6-7. Annexation; intergovernmental agreement. |
8 | | Whenever an unincorporated parcel of land that is within the |
9 | | boundaries of a fire protection district is annexed into the |
10 | | corporate limits of a municipality with a municipal fire |
11 | | department, the municipal fire department and the fire |
12 | | protection district may negotiate an intergovernmental |
13 | | agreement to allow the fire protection district to have |
14 | | jurisdiction over the annexed parcel in such instances when it |
15 | | is not economically feasible for the municipal fire department |
16 | | to have jurisdiction over the annexed property or when the |
17 | | municipal fire department has determined that a hardship exists |
18 | | that would compromise the safety and well-being of the annexed |
19 | | property. If no agreement is adopted by both the municipality |
20 | | and fire protection district, then the automatic transfer of |
21 | | jurisdiction from the fire protection district to the |
22 | | municipality shall occur upon annexation.
