SYNOPSIS AS INTRODUCED:
 
50 ILCS 750/15.2a  from Ch. 134, par. 45.2a

    Amends the Emergency Telephone System Act. Provides that in order to enable access to a 9-1-1 system for cognitively-impaired, disabled, or special needs persons, the installation or connection of any automatic alarm, automatic alerting device, or mechanical dialer shall be allowed. Provides that the device shall be used only in an emergency situation reported by a caregiver after initiating a missing person's report. Sets forth the requirements for the device.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Emergency Telephone System Act is amended by
5changing Section 15.2a as follows:
 
6    (50 ILCS 750/15.2a)  (from Ch. 134, par. 45.2a)
7    Sec. 15.2a. The installation of or connection to a
8telephone company's network of any automatic alarm, automatic
9alerting device, or mechanical dialer that causes the number
109-1-1 to be dialed in order to directly access emergency
11services is prohibited in a 9-1-1 system.
12    This Section does not apply to devices used to enable
13access to the 9-1-1 system for cognitively-impaired, disabled,
14or special needs persons in an emergency situation reported by
15a caregiver after initiating a missing person's report. The
16device must have the capability to be activated and controlled
17remotely by trained personnel at a service center to prevent
18falsely activated or repeated calls to the 9-1-1 system in a
19single incident. The device must have the technical capability
20to generate location information to the 9-1-1 system. Under no
21circumstances shall a device be sold for use in a geographical
22jurisdiction where the 9-1-1 system has not deployed wireless
23phase II location technology. The alerting device shall also

1provide for either 2-way communication or send a pre-recorded
2message to a 9-1-1 provider explaining the nature of the
3emergency so that the 9-1-1 provider will be able to dispatch
4the appropriate emergency responder.
5    Violation of this Section is a Class A misdemeanor. A
6second or subsequent violation of this Section is a Class 4
7felony.
