Amends the Code of Criminal Procedure of 1963 if and only if Senate Bill 3539 of the 96th General Assembly becomes law.
Provides that the following question of public policy shall be submitted to the electors of the State at the 2012 general election: "Should the General Assembly of the State of Illinois enact a law providing for capital punishment for first degree murder and establishing procedures for the imposition of capital punishment that are consistent with the United States Constitution as interpreted by the United States Supreme Court?". Contains an internal repealer. Effective immediately or on the effective
date of Senate Bill 3539 of the 96th General
Assembly, whichever is later.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. If and only if Senate Bill 3539 of
the 96th |
5 | | General Assembly becomes law, then the Code of Criminal |
6 | | Procedure of 1963 is amended by adding Article 106F as follows: |

8 | | ARTICLE 106F. QUESTION OF PUBLIC POLICY; CAPITAL PUNISHMENT |
9 | | (725 ILCS 5/106F-5 new) |
10 | | Sec. 106F-5. Question of public policy; capital |
11 | | punishment. |
12 | | (a) The State Board of Elections shall certify the question |
13 | | to the proper election officials who shall submit the question |
14 | | at the general election in 2012 in accordance with the general |
15 | | election law: |
16 | | "Should the General Assembly of the State of Illinois enact |
17 | | a law providing for capital punishment for first degree murder |
18 | | and establishing procedures for the imposition of capital |
19 | | punishment that are consistent with the United States |
20 | | Constitution as interpreted by the United States Supreme |
21 | | Court?" |
22 | | The votes shall be recorded as "Yes" or "No". |
