| 5 | | "Section 5. The Department of Human Services Act is amended |
| 6 | | by adding Section 1-55 as follows:

| 8 | | Sec. 1-55. Contract performance metrics. |
| 9 | | (a) Consistent with the objectives of budgeting for |
| 10 | | outcomes, as soon as practicable after the effective date of |
| 11 | | this amendatory Act of the 97th General Assembly, the |
| 12 | | Department of Human Services, in coordination with the |
| 13 | | Governor's Office of Management and Budget, shall undertake a |
| 14 | | review of the Department's contracts and grants to assess which |
| 15 | | contracts and grants, and categories thereof, are appropriate |
| 16 | | candidates for the implementation of a performance-based |

| 1 | | contract evaluation model. |
| 2 | | (b) The Department shall refine current performance |
| 3 | | metrics and develop new metrics for programs, including |
| 4 | | contracts and grants that fall within the categories determined |
| 5 | | to be appropriate by the Governor's Office of Management and |
| 6 | | Budget and the Department under subsection (a). Performance |
| 7 | | metrics may be based on required program components and a |
| 8 | | methodology that incorporates the reasonable costs of the |
| 9 | | required program components. |
| 10 | | (c) The Department shall ensure that service contracts and |
| 11 | | agreements, as deemed appropriate under subsection (a), |
| 12 | | include performance reporting requirements. Starting in State |
| 13 | | Fiscal Year 2014, Community Services Agreements shall |
| 14 | | explicitly outline performance reporting requirements, |
| 15 | | detailing the specific performance metrics to be reported, the |
| 16 | | method for submitting metrics, and the frequency of the metrics |
| 17 | | reporting. |
| 18 | | (d) The Department shall enhance its processes to monitor |
| 19 | | and address noncompliance with reporting requirements and with |
| 20 | | program performance standards. Where applicable, the process |
| 21 | | may include a corrective action plan. The monitoring process |
| 22 | | shall include a plan for tracking and documenting |
| 23 | | performance-based contracting decisions. |
| 24 | | (e) Notwithstanding any other provision of this Section, |
| 25 | | the provisions of this Section shall be applicable to all |
| 26 | | contracts and grants funded by the Department in an estimated |
