| 1 | AMENDMENT TO HOUSE BILL 1425

| 2 | AMENDMENT NO. ______. Amend House Bill 1425 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The State Finance Act is amended by adding | ||||||
| 5 | Section 5.786 as follows: | ||||||
| 6 | (30 ILCS 105/5.786 new) | ||||||
| 7 | Sec. 5.786. The Electronic Health Record Incentive Fund. | ||||||
| 8 | Section 10. The Illinois Public Aid Code is amended by | ||||||
| 9 | adding Section 12-10.6a as follows: | ||||||
| 10 | (305 ILCS 5/12-10.6a new) | ||||||
| 11 | Sec. 12-10.6a. The Electronic Health Record Incentive | ||||||
| 12 | Fund. | ||||||
| 13 | (a) The Electronic Health Record Incentive Fund is created | ||||||
| 14 | as a nonappropriated trust fund to be held outside the State | ||||||
| |||||||
| |||||||
| 1 | treasury, with the State Treasurer as ex-officio custodian. The | ||||||
| 2 | purpose of the Fund is to receive and disburse funds pursuant | ||||||
| 3 | to paragraph 1903(a)(3)(F) and subsection 1903(t) of the Social | ||||||
| 4 | Security Act. The Fund shall consist of: | ||||||
| 5 | (1) All federal moneys received by the Department of | ||||||
| 6 | Healthcare and Family Services for payments to qualifying | ||||||
| 7 | health care providers to encourage the adoption and use of | ||||||
| 8 | certified electronic health records technology. | ||||||
| 9 | (2) All other moneys from any source, including | ||||||
| 10 | interest thereon. | ||||||
| 11 | (b) Disbursements from the Fund shall be made at the | ||||||
| 12 | direction of the Director of the Department of Healthcare and | ||||||
| 13 | Family Services to qualifying health care providers in order to | ||||||
| 14 | encourage the adoption and use of certified electronic health | ||||||
| 15 | records technology.

| 16 | Section 99. Effective date. This Act takes effect upon | ||||||
| 17 | becoming law.".
